CCJ CEL set aside application

Hi All,

I need some help pls. I just found while reviewing my credit score in anticipation of a mortgage application i have a CCJ against my name £345 from Civil Court Enforcement Ltd. But it seems tied to my old address, i checked the date and it was issued in November of last year. I have never received anything in the post , no notifications in writing, no emails or contact via phone. I panicked upon seeing this found the details and paid the amount immediately. I am now concerned i have made a mistake by paying so swiftly, as am i still able to have this set aside as i received no contact from the court or company it is related to? or as i have now paid am i only able to have it marked as settled?

    Presumably you moved but didn't inform the DVLA in time??


    Read up on now going for a set aside by consent (if you just want the ccj expunged from the record), or a full set aside hearing if you want to fight the claim


    (Hopefully they will inform the court you paid and the ccj will be marked satisfied, though you probably will still have problems as far as getting a mortgage etc is concerned)

    The original PCN was dated from Feb 2017 about 6 weeks after I moved. so may have been issued while it was being updated.

    As i have already paid the full amount am i still able to apply to have it set aside by consent?

    Yes, you can try. Read up on "set aside by consent" to understand what is involved.


    Get advice on how to word the order if you do go that route.


    The courts don't like it if they see it as purely a credit score "cleansing"

  • Have read a few, thanks for pointing me in the right direction.

    What I am currently struggling with is getting in touch with CEL all i can currently find for them is a postal address and automated phone line. Is there anyone that has dealt with them before and found a more effective way of communication? any email or online contact details?

    Never a good idea to speak to a ppc - they could trick you into inadvertently "incriminating" yourself.


    Keep copies of all correspondence and bear in mind "without prejudice"
  • Ok, but i thought I needed to speak to / correspond with them to have the CCJ set aside by consent?
    As I already panicked into paying the CCJ as soon as i discovered it do i need to worry about "incriminating" myself?

    Sorry to be asking so many questions, just very stressed and confused about how best to proceed

    Assuming you want to try for a set aside then no need to contact them at all.


    The courts will send initial notification.


    A set aside by consent will mean you can't then defend the claim and get your money back
