Ok, so I've checked my LBC. They did provide:
- a copy of the Information Sheet and the Reply Form (provided at Annex 1 of the Debt PAP) and
- a Financial Statement form. (Annex 2 of the Debt PAP).
I did not reply. Should I make reference to my failure to comply with the protocol in my defence or omit this and leave it to them to bring that up?0 -
No big deal. If you lose it'll make very little difference. If you win, C may successfully argue for a modest reduction to your costs. Even in high value claims the parties don't always comply (much to my irritation).
There is a bigger battle to win now!0 -

Your defence needs to focus on why there was no contract, no liability, etc.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
