Help! Parking ticket blew upside down

Hi Everyone,
Just recieved a letter of claim LOC from BW LEGAL after a parking fine from Britannia Parking.
Here's the letter:
https://ibb.co/bZcvSA
https://ibb.co/nMzW0V
Car was parked in a P&D car park (over a year ago) during very, very windy weather, so windy the storm had a name.
Ticket was placed facing upwards on dashboard, but after returning to the car found had a britannia parking invoice attached to the window and the ticket was upside down on the otherside of the dashboard.
The ticket didnt have any sticky, so was unable to stick it to the window.
Still have the original ticket, which was paid for using a bank card and have bank statements to show this.
POPLA rejected the claim.
Can anyone offer any advice please?
Thank you so much!0 -
Formal LBC - deal with it as per NEWBIES FAQ sticky, post #2 which guides you right through from the issue of (and response to) a LBC to the eventual (but not necessarily inevitable) court hearing.
Try keeping a clothes peg or a bit of blutack in the car to make sure you never get a flipped ticket again. Be aware that almost every PPC has these flimsy, non adhesive tickets, as they each carry the potential for £100 income a piece.
Wise up to the scam - get ahead of it. A simple peg can save you a ton! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks Umkomaas, will check now.
It was during Storm Brian, not sure how it blew over, may have blown over while getting the kids out of the back, shutting door or even from air coming through air vents as it was a very windy day.0 -
Fluttering ticket cases have been successful recently. If you search fluttering ticket you should find some cases of where the judge has ruled in favour of the defendant. These cases (especially where the reg. number is input) don't do the PPC's any favours. It shows them up for the scammers that they are.

frog_bounce ...... Re the BWLegal letter
The Principal debt is £85. BWL have added a fake £60 which they claim is debt recovery costs.
This magical figure of £60 seems to cover a whole host of reasons dreamed up by BWLegal.
They often call it "admin ... contractual charge .. solicitors fees" but in reality they are trying to extort an extra £60 from you
Did you get letters from DRP (Debt recovery plus) ???
The £85 is a contractual debt as per the signs
PLUS £25 court fee
PLUS £50 legal fee
PLUS small interest charge that a judge may not allow.
The £60 is a fake add-on and they must prove to you the validity of this amount.
BWLEGAL ADD ON A FAKE £60 ?
In addition to the 'parking charge', the Claimant's legal representatives, BWLegal, have artificially inflated the value of the Claim by adding costs of £60 which has not actually been incurred by the Claimant, and which are artificially invented figures in an attempt to circumvent the Small Claims costs rules using double recovery. >>>> thanks to bargepole
This is something a judge would be very interested in0 -
Hi, yes, had DRP letters.
I am thinking of sending a SAR to Britannia.
Should I send the SAR a few days before the letter of claim is due to expire or straight away?
Thank you!0 -
Straight away, as a SAR can take 30 days, and you are best seeing their hand before the claim.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi.
Got a response to the SAR.
Doesnt look like BWLegal know we have a copy of the ticket.
Britannia sent their SAR with photos of the upside down ticket in the windscreen.
Thinking of writing to BWlegal to let them know we have the ticket and plan to reject their claim?
What would you do now? Thanks0 -
It was during Storm Brian, not sure how it blew over, may have blown over while getting the kids out of the back, shutting door or even from air coming through air vents as it was a very windy day.
Nothing to stop you sending a copy of the ticket to Britannia, BW Legal and the landowner for that matter, in a major complaint letter designed to get the landowner to order it cancelled before you publicise this little scam on TripAdvisor, review sites and/or the local press...
Turn the screw and try to get it cancelled by whoever took on B. And no, B won't tell you who that is of course.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The retail park management office have said that they are unable to help as they do not have the power to cancel parking tickets because all management of parking fines have been passed to brit park0
