Cream DFS Sofa Delivered Stained

Just had a new cream 3 seater sofas delivered with a big black dirty mark on one of the cushions. I informed the delivery guys who took photos and said DFS would send someone out to clean it.
I told the delivery drivers I will only accept a new cushion, as the sofa is not scotch guard protected and it is new.
I went to the store to discuss it with the manager who tells me it is their procedure to send out an upholsterer to see if it will clean and the earliest appointment would be Monday the 5th of February. This would mean me taking holiday leave to be there.
Do I stand my ground and refuse to have it cleaned. I could collect a new cushion from the store any evening.
Thoughts/Advice please?

Why not suggest you drop it off to the store before the date the upholsterer can clean it and he could do it there? That way you could check the quality of clean before collecting. Please do not quote spam as this enables it to 'live on' once the spam post is removed.
If you quote me, don't forget the capital 'M'

Yes I could do that, but that is only one issue here. Why should I have to accept a brand new sofa that has been cleaned?0

I guess I’d have to see the mark to decide whether you were being precious or not, but you don’t know that your ‘new’ sofa wasn’t marked in the factory and cleaned up. You’d never know.0

You ordered a cream sofa without scotchguard protection???
Are you going to just sit on the carpet and admire it? Or only allow those dressed in white to sit on it?
Give them a chance to remedy it.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
Because the law says the retailer gets to choose the remedy.
Not in the first 30 days they don't.
OP, just tell DFS you're exercising the short term right to reject (ie return the whole thing for a refund). You do not have to accept a repair and if DFS tell you anything different, remind them its a criminal offence to mislead consumers about their statutory rights.
You could say that you'd be willing to reconsider the rejection if they replace the damaged cushion.
Tbh your first mistake was buying from DFS - search the boards, you'll find hundreds of threads about how shoddy their goods are.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

Thank you Unholy Angel for submitting accurate advice.
I follow this forum and having given advice myself several times,, but just wanted another opinion.
Before the replies I had already sent an email to the store and their Head Office rejecting it unless they replaced the cushion and also mentioned my rights to reject as per the Consumers Rights Act 2015, also saying I would contact my credit card and do a chargeback.
This quickly brought a call from the Aberdeen DFS Store to say a new cushion had been ordered.
As a side note,DFS first arrived with the wrong sofa,a green one which turned out to belong to a customer with the same name but lived 60 miles away. Eventually a second lorry arrives with the correct sofa, albeit they unwrapped in to find a huge dirty mark on a cushion.
This Sofa is actually for my sons flat, his last one was only 2 years old and it was skipped and got him this one in the DFS sale, it was I thought a bargain at £264 for a 3 seater sofa, but was not going to pay an extra £60 for scotch guard protection. There are now throws over it to protect it, so hopefully it will get looked after better this time.0 -

I think I'm one of the few lucky ones! Bought a 4 seater, 3 seater and armchair in leather and it still looks good, despite our 7 year olds best efforts and our lack of treating it with anything more than a sponge and soapy water, after nearly 14 years. We must also be one of the only ones to buy at full price0 -

I bet it’s not a cream one0
