Have I been conned? Carphone Warehouse

I don’t know much about mobiles I’ll admit. I have a iPhone 6s which was on a 24mth contract at the cost of £37 a month. I finished my contract but wasn’t told so basically the 30 day period of quitting rolled over so I was continuously paying £37.

Went into Carphone Warehouse and told them everything and I wanted a Sim only plan or pay as you go because I’m fed up of paying the £37. The manager who served me told me I’d have to go to O2 but I’d have to mess about changing my number and that they’re stopping doing pay as you go because of iPhones and androids your not going to get much for £5 here and there, and it’s not worth it cos you have to pay a plus charge of £20. He said my iPhone is not going to last me long and I will eventually not be able to do much with it due to apple scandal. In the end I ended up trading in my phone for £50 with a 24mth contract for ANOTHER iPhone 6s with double the data and GB for £29 a month. Yes it’s cheaper but I feel roped in to a contract I didn’t need. I put full confidence in that guy cos I haven’t a clue and everyone is telling me I’ve been conned.

TL;DR - wanted a sim only contract after finishing contract and going over 30 day limit. Pay £37 a month. Traded in iPhone 6S for another iPhone 6S for £50 and £29 a month which has double GB and free texts and calls.

    If you where uncertain you should have come on here and you would have got some good advise.
    it sounds like you where conned. £50 for your old phone? you would have got 3 times that selling it private also didn't bells start ringing when he sold you another iphone 6s which he had just told you it would be no good?

    Payg are not going to stop and your iphone 6s would last at least another year maybe two even longer to be honest.
    You should have stuck to your guns and just walked out of the shop until you got some good advise.
    Trouble is there is no returns on upgrades afaik so you are stuck with the same phone you had for another 24mths

    By the way your contract does not just Finnish its only the minimum term.
    Min. Term is how long you must remain in contract and keep paying charges, The contract continues beyond the Min. Term, but you may then terminate it at any time by giving a month's notice.

    I'm with sdduk on this one

    I also had an Iphone 6s on a 24 month contract at £36 pcm and renewed in December once it had expired to stay with EE on a sim only at £14 pcm on another 12 month contract with tripe data etc...

    Maybe you can still get out of the contract but it sounds like you bought in store so 14 day returns may not apply.

    A lesson everyone should learn. When you're dealing with sales people they are there to SELL. It's up to YOU whether you step back and forge ahead. Nothing much you can do in this instance after the event, except ask them - highly unlikely they will cancel this and, quite frankly, why should they??

    This is the part I found most deceiptful.

    I assume the "scandal" he is referring to is the recent battery issue which affects the iPhone 6S, and is hardly a "scandal" in my opinion.

    He therefore implies this will make your 6S worthless, yet then proceeds to sell you another one!

    The most annoying thing is the "scandal" only relates to the behavior of the software as the battery ages, (something all batteries will do as they are limited life components).

    However, as a goodwill gesture, Apple have reduced the price of a battery replacement for 6S users from £79 to £25 until the end of 2018. This replacement would have made your phone basically identical to the one you have just been sold (bar a couple of scratches) as the rest of a phone generally does not "wear out" but instead tend to be replaced simply because they are considered to be "outdated".

    I have a two and a half year old iPhone 6S which is still more than good enough for my needs however the battery is (as expected) quite worn out. I will take advantage the Apple £25 replacement this month which will hopefully allow me to get another 3 years of use out of it along with my £10.00 "SIM only" contract which gives me unlimited texts and calls plus 20GB of 4G data.

    Due to the OP changing plan in store they don’t get the 14 day distance selling cooling off period. Sadly there is nothing the OP can do but learn from their mistake on this occasion. Never trust a salesman and next time take a friend who is savvy and can help you.

    OP in future dont go and sign up for a contract without asking for advice first, you need to learn to not get rakl roaded into something you don't need.

    How much do you use of your allowances ?

    Had you upgraded the battery then got a rolling monthly sim only, you could have kept going until it didn't suit you or the phone gave out.

    You are better looking in the shop then ordering online- you can usually get cashback, sometimes better prices and importantly return rights.
