CCJ - Received County Court Claim Form today help??

    In a county court claim pack there is the N9A admission form (if you admit the debt and want to make an offer of payment), the N9B defence form (if you want to dispute you owe the debt) and an acknowledgement of service (this extends the time limit to reply from 14 to 28 days if you need more time to file a defence).


    You must respond to the court claim within 14 days, unless you have returned the acknowledgement of service because you want to defend the claim. You will not have a CCJ until one has been entered against you. And as long as you pay the CCJ within a month, the CCJ will not be registered on your credit file.

    Thanks for your reply. It is very confusing. It says:

    If you agree with all the claim and wish to pay it now - Take or send the money to the claimant. You should ensure that the claimant receives the money within 14 days of the date of service.

    Or

    If you agree with all of the claim and are asking for time to pay - Complete the admission form (N9A) and send it direct to the claimant. Do not send a copy to the court. Entering an admission may result in judgement being entered against you.


    Reading those I think I am the first one as I don't need time and I definitely don't want a judgement against me. The first one doesn't say to complete the form.


    On the N9A form it says only fill this in if:
    -You are admitting all of the claim and are asking for time to pay
    Or
    -you are admitting part of the claim

    As I'm not asking for time to pay I think I just pay and then phone the court and tell them I have paid.

    You pay the claimant and get a receipt, that should all that is needed. The summons (claim form) is deemed served 5 days after the issue date and you have 14 days from the service date. You could have longer its just the claimant cannot request for a judgement until after the 14 days, it isn't automatic.

    It certainly sounds like a claim form. If you can afford to pay the whole debt, including the fees that have been added, then go ahead and do that. Make sure your payment has been received by the claimant within the 14 day time limit.


    You need to make sure you have proof of your payment, such as your bank records or a receipt. The claimant should not ask the court to enter a CCJ if you pay the debt. You can also contact the court just to confirm the debt has been paid.


    I know dealing with court papers can be stressful, but try not to worry as there is no reason a CCJ should be made if you pay the debt now.
