I have received a County Court Claim Form in the post today. Does this mean the person has applied for a CCJ against me?
I received an invoice by email for ground rent from a property I own on 1st October 2017. The dates are wrong on it (01/10/2017 - 31/03/2017) it should have read March 2018. I replied to the email to query the dates and the amount, I did not get a reply to my query about the amount I owed. I then forgot about it. I have not been contacted or chased once since then which I find disappointing. I am a director of the tenants company who have made the claim against me!
I don't understand how they have got £733.33 to £743.28??? I have tried to calculate the daily interest but it doesn't add up? Help? It says they will send me a separate detailed particulars in 14 days but I need to respond before that and I don't know what to do! The main thing is I don't want a CCJ registered... is it too late now
What happens now? If I pay in full will I still get a CCJ registered against me?
Thanks for your help

Do you lease a property?
If yes, you have to pay ground rent. As such, you have a limited time to pay this in your lease agreement, and a contractually obliged to pay it.. I assume that because you have a query, it gives you a right to avoid the payment.
As for the incorrect date, that can be correct at the same time.
I don't know about the court as I don't attend these! But suggest you settle up pretty fast and don't ignore in the future.0 -

I am not questioning the fact that I need to pay it although I need advice to how the total has been worked out and how to deal with the Claim Form. E.g if I pay in full can they still issue a CCJ. Thanks0 -
Yes that looks like a CCJ form.
If you pay it in full within 1 month of issue it will get removed from your Credit Files as if it never existed...
If in doubt about the amount - call them and ask0 -

Does it definitely not get recorded on my credit file if paid in full? It says I have to send payment within 14 days0 -
The 14 day payment is for the original invoice but you have 14 days to respond to the claim. The £743.28 is arrived by adding 5% annual interest for 3 months. If you pay now, including the £60 court fee, you can avoid it going to court - one of the boxes on the claim is for that. If it goes to court and you pay within 28 days there will be no record on your credit file. https://www.gov.uk/respond-to-court-claim-for-money0

This is just a claim form, so there is no actual CCJ yet, and nothing will go on your credit files unless a CCJ is issued because you do not pay.
If you agree you owe the money then you need to pay the creditor (get proof) and respond to the claim form saying it has been paid in full.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Thanks for your advice. I feel a little less panicked now. There only appears to be options on the form by wanting more time or disagreeing. Does that sound right, that you only complete a form if you don't pay??0 -
Hi gemmylouise
In a county court claim pack there is the N9A admission form (if you admit the debt and want to make an offer of payment), the N9B defence form (if you want to dispute you owe the debt) and an acknowledgement of service (this extends the time limit to reply from 14 to 28 days if you need more time to file a defence).
You must respond to the court claim within 14 days, unless you have returned the acknowledgement of service because you want to defend the claim. You will not have a CCJ until one has been entered against you. And as long as you pay the CCJ within a month, the CCJ will not be registered on your credit file.
