Newbies will think that if they were not the driver, that they need to deal with the PCN themselves. This is obviously incorrect and people who come here should be told that if they were not the driver they should give the driver details to the Parking scumbags so you cannot be taken to court. This is the Money Saving approach....

Your advice is obviously incorrect in the majority of cases (i.e. where a keeper's vehicle is being driven by a friend or family member).

I first came across the murky world of Private Parking over 4 years ago when UKPC tried to unfairly extract money from my teenage son over a "parking incident" when he was driving a car registered in my name. Having absorbed the good advice on MSE and pepipoo, I challenged the PCN myself (as keeper) and beat UKPC at POPLA.

Please explain why dobbing my son in to UKPC would have been the "Money Saving approach".

I warn potential posters about giving away too much info.

Might be a good opportunity to incorporate into the Newbies thread?

Regarding the NI and Scotland situation, should there be something telling people from there what to do if they get a PCN in E and W? As far as I can see, the FAQ only covers what to do if the alleged event took place in NI or S, not what NI and S keepers should do if the alleged event was elsewhere in the UK.

Should the timings be either 14 days, and 28 to 56, or 15 days and 29 to 57?

If they are a firm which alleges 'keeper liability' under the POFA 2012 (which they don't have to!) the a postal PCN must arrive by day 14 if there was no windscreen ticket.

Or, the NTK must arrive with you between day 29 and day 57 if there was a windscreen PCN.

At the moment it reads 14, and 29 to 57. Should there also be an explanation of day zero/day one?

  • The biggest thing that needs changing is to find a way to get the "too lazy to read stuff, I'd rather clog up the board" muppets to actually read it.

95% of threads on this board are answered by reading the stickies....yet few[?] bother to do so.

That would be the Donald Trump approach. What he, along with those you are referring to, don't understand is that in order to get to grips with a complex topic, it actually requires some investment of time and brain-power. It isn't something which can be condensed to 140 characters, or even a single page.

CM - Perhaps a ‘How to Use the Search Function’ and a response to the ‘Do I send a letter or an email or via the PPC website’. I’ve made my own two template responses which I copy and paste (quite frequently) rather than typing the same old time after time. Here’s what I use, if you want build either or both of them in, feel free, similarly if you want to rehash them.
HOW TO USE THE SEARCH FUNCTION

Use the Forum Jump button (one near the top and one near bottom of this page) to get back to the forum thread list. Just above the threads, on the right, is a heading along a line, next to forum tools, called 'Search this Forum'. Put your key word(s) in and change the default search from 'Show Threads' to 'Show Posts'.
    SUBMITTING AN INITIAL APPEAL

Make sure the initial appeal is sent to the PPC by their deadline date, normally 28 days from the date on the NtK for a BPA Operator, (21 days for an IPC Operator, but no POPLA for IPC Operators), otherwise you can kiss goodbye to POPLA. If it’s a windscreen ticket send around day 25/26 for a BPA operator or day 18/19 for an IPC operator.

Also, equally important in the submission of the initial appeal, you follow precisely the method by which they require you to send the appeal. Preferably do it via their website appeal portal (if that’s the method they require). But if it says by email, don’t send it by post (or vice versa). If it asks for the keeper’s name and full postal address - give it, don’t provide an email address instead, or try to be clever with a M Mouse, Orlando, Florida!

Be wary of any drop down box if the appeal is via a website appeal portal, that defaults to ‘I am/was the driver’ - make sure that isn’t showing when you press the ‘Send’ button.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Is it possible to make the Sticky title in bold Red, preferably sparkly and flashing with cannon fire and fireworks, not that I think that will work for every new poster? *sigh*

I suspect I'll be in the minority here but suggest you scrap the sticky in total. No offence C-M.

It takes less time to answer the OP's question than it does to type in the nonsense about "being polite" or even worse the aggressive know-all "it's in the sticky".

There is a reason that courts take each case on its merits which is that each case is subtly different. Templates while useful are only a half-way to reading, understanding, retrieving the correct information and answering the question.

I respect your opinion IamEmanresu, always have, but I think behind the scenes there are loads more people than we realise, using the NEWBIES thread and winning, without needing to post to ask anything. Hope so.

And we must be doing something right with 99% win rate at court, and similar (a close second) at POPLA.

Before the NEWBIES thread existed we were drowning in queries. Can't do that again and I am sure Quentin and others copy & paste a standard response, no typing needed to signpost people to the answer.

What was the thing I promised to add, earlier this month? Something useful on a thread you also posted on...I recall saying to you 'I will but I am going out now' then never had time/real life took over. Can you remember?
