I seem to remember somebody tried this on with a parking company, ended up in court, and was slapped down by the judge.
When asked where the defendant got the idea, he said, off Facebook. The judge found in favour of the parking company.

With the £ figures quoted, I think there’s been too much time spent on the Monopoly board.

I wonder why none of the regulars who, between them, have dealt with tens of thousands of private parking cases over many years, have never once thought of this before?

MSE should sack the lot of them! :D

When I used to frequent usenet there were always fools trying this sort of thing. TFOTMI, PPCs take people to court and win, deluded cyber warriors do not.

you'll find their 'solicitors' or 'debt collectors' are all at the same address. only a court can instruct debt collectors, not some herbert in a tank top for a mickey mouse parking outfit

So would you intend showing this ‘contractual letter’ of yours to a judge as part of your evidence that the parking company had accepted your terms if they don’t pay your demands?

    Do tell us.

    NEWBIE alert - stop!

Please instead use the template appeal in NEWBIES PLEASE READ THESE FAQS FIRST.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
  • I, like many others, found this forum when using Google to try to find advice on dealing with a PCN and was very kindly given the advice and pointed in the RIGHT direction for template letters.

This kind of misinformation could be really damaging to someone's case, hopefully it'll be removed ASAP.
  • There's a very very very very slim chance that this might fly if the PPC didn't turn up in court.....but only if the judge was up for a laugh or trying to make a point/name for themselves.

This has been tried before, the ppc just said the driver entered into a contract as displayed on site by staying over a reasonable grace period.
The letter they received had no worth as they had not entered into any contract to pay the sender.
Moreover by ignoring an established appeals procedure endorced by an ATA a judged would likely take a very dim view and side with the ppc, that can bring a court claim up to six years later.

In other words ignore tried and tested forum advice and get your fingers burnt.

Brillliantly, by titling it "without prejudice" you simply ensure that you cannot prove the existence of your mythical "contract" to a court!

Its so hilariously awful, I assume the OP is a stogge for a parking firm hoping people will fall for this rubbish.
