Requesting a refund

I recently bought an Item on eBay. The item was described as new in original packaging and costed as much as new item (it's fragrance I am talking about), it was also listed under the category 'Fragrances & Aftershaves for Men' Somewhere in the description it did said that the item was only a box but I didn't notice that since the price, category and item's condition all spoke to me as it's an original item. I tried contacting eBay yet they refused to provide a refund as 'it was clear was I was buying'.
Anything I can do? The seller called me a 'Silly Cow' :(

    Seems to me you ordered an overpriced box and got exactly that. You would have to show the item was misdescribed....and it doesnt look like it was.

    Or course it was misdescribed if it was not in the right section. Empty boxes are not sold in the same section as the proper item. Classic scam.

    Op your easiest option is to open a case in eBay's resolution centre for SNAD (significantly not as described). The item specifics section forms part of the sale description and as per Carrot above, the item should not be sold in the wrong category as it is intentionally misleading.

    Edit - sorry I only just saw the bit about having contacted eBay. Did you open a dispute already?
  • Yes, I did, they responded that it was clear the item was only a box and refused to reopen the case. The category and description means nothing for them, because in the description seller already said it's only a box.

    Ebay did allow refunds when people were selling xbox, playstation etc boxes that were deliberately misleading.

    Do you have an address for the seller in the UK?

    If so, small claims court is a good option.

    I sell on eBay, and the amount of people that can’t read a description is staggering.

    The item specifics form part of the sale. If the seller provided those (let's say wattage of said item or headphone lead etc, then it's a SNAD). Clearly the Rep was poor.

    Yes.

    OP, if you have had an eBay case opened and closed then follow these instructions to the letter:

    1. Play the seller at their own game.
    2. Log into Paypal.
    3. Crush the box you were sent. Take a photo.
    4. Open a claim for item not as described.
    5. Add the photo of the crushed box to the Paypal claim.
    6. Register with Paypal's "returns are on us" for a reimbursement should you be required to return the item, they will reimburse £15.
    7. Wait for Paypal to assess the case.
