It is annoying (to me anyway) when promoters moan. I don't know the story behind this one so am only speaking generically.

Very rarely are they doing it solely from the goodness of their own hearts. I don't see them moaning in quite the same way about the exposure that they get for their product/service. Even if not their target audience they're often benefiting by hits to websites, increased followers (looking impressive to their target audience) etc.....

You're always going to get campers that are PITAs, but from what I've seen over the years compers can be very loyal and supportive of a business or service. Plus you never know who you're dealing with, it's like Pretty Woman all over again. Anyway, what can you do?!?!

It's a facebook giveaway.. is that legally the same as a Free Prize Draw I'm no expert and I doubt that they are.

They've clearly made a mistake.. I don't disagree with you on that.. I just feel that raising a formal complaint is a little heavy handed.
They could have simply lied and said that Christine was the 1st pick had they wanted to.

Why not just contact them and explain the legal differences?

If he didn't want compers he could have easily posted something to that effect or posted some rules where has asked entrants to post why they wanted to win.

He was happy for the so called compers to share his page and raise his profile and then admits that two other people came up as winners but he went and looked at their profiles and deemed them not worthy.

Sorry, but nothing about this sounds like a nice guy or made a mistake. Terms were that it was a random draw and he refused to comply with his own rules.

I for one have reported him and shared his shady competition on my Facebook and Twitter accounts.

Oh and I did contact him and he blocked me instead of responding.

Fair enough.. I take back what I said. I guess he isn't as nice/naive as I thought.

None of you have noticed comps where the prize mustn't be sold on ? I must be the only person reading the terms & conditions these days.

Had you won it would you have used it? Seem a very specialist product.

I for one would have no conceivable use for one.. not even sure I understand what it does.

    If not then why complain?

I didn't enter, I don't know what it does. However I have an adult child who is a musician/composer who would have loved this. If I had entered and won, it would have been given to the child. However I never could have won because the sponsor was checking possible winners to see if the complied with his views. My Facebook is full of kid pictures, animal pictures and memes. Don't think I was his sort of winner.
That's hardly fair when by entering I would have raised his profile to a few hundred people, companies run competitions for reasons of exposure then complain it's the wrong type of exposure without any real validation?

I have seen that but how can it be enforced? Unless there are only a few items all numbered, who would know what was sold by whom?

I've noticed a slow tightening of the rules, including this. I searched "prize must not be sold" and the google results are mostly tickets and holidays, which are easy to enforce. I thought I saw it on a car comp too.

The first person chosen has been cheated out of what is legitimately their prize then when a second person was drawn they were also cheated out of the prize - It is therefore without question what the person doing this is, one wonders if they have been involved in any other competitions where their prejudices have led them to cheat more people out of their prizes.

Well I guess some prizes are easier to track than others. I was thinking more of merch for films or books, DVD's and the like.
Yeah a car can be traced, a holiday is usually booked in the winners name so that's reasonable imo and even event tickets are being sold on the premise only the buyer can use, rather than resell so I get it.
I did see it on a vacuum competition and thought how are you gonna check if I sold it ? As it happens I desperately need a new vac and wouldn't sell on but still how could they enforce it. Illegal term I think. After all once it's in your ownership it's then yours to do as you please.
