Tesco Mobile Contract Change

I have just received a text from Tesco Mobile informing me that they are saying goodbye to some of their older tariffs and they are going to move me on to a new tariff on 23rd February.

For a number of years I have been on a rolling monthly contract (at a very good price) that gives me 500 minutes, 5000 texts and unlimited data and Tesco Mobile staff have told me in the past never to change from this deal as they are no longer available. The new tariff will be 500 minutes, 5000 texts and 10GB of data.

I would obviously prefer to hold on to the unlimited data allowance (even though I have only ever used a fraction of it) so my question is "do I have to agree to this?" and "is Tesco Mobile legally entitled to enforce this change?"

    Yes, they are legally allowed to do so.

    No, you don’t have to agree to the change, you can give your notice and leave the network if you wish...

    These early 'unlimited tariffs' had a fair use value of something like 2GB and then they started to charge. They also refuse to cap them.

    My father didn't activate Wifi on changing phones - got a bill for the data above the tiny 'fair use' limit. Now he rarely uses the any non-WiFi data.

    So 10GB will be enough then - take the deal or move to another provider

    Likewise I have been on this contract since 2010 and I can't see anything in the contract that allows Tesco to arbitrarily close it and move contract holders to another contract unless the client defaults. Is this legally qualified or is it a case of another Multi National trying it on to remove clients from less profitable contracts?
    I would appreciate a view from any of you who have the necessary legal expertise please as I an certain despite however Tesco Mobile excuse their actions it is intended to benefit them not the customer.

    Seems quite black and white (or blue ;) ) that this term covers it:
    5.4 We may end your Service Agreement at any time by emailing you and giving you 30 days notice.

    So they are ending your current agreement, and offering to supply you with a new one. As said above, you are completely free to move to another network if you are unhappy.

    As you only have to give Tesco Mobile 30 days notice to leave, what makes you think they can't do the same to you?

  • I have a very old tesco mobile contract with 500 mins unlimited texts and unlimited data. These though are subject to a fair use allowance of 500 mins 5000 texts and 2048 mb of data yet whenever I get close to 1 gb of data use they start sending texts telling me I will have to pay for any extra, when I ring I am told that I should ignore them and they will roll onto another gb of data. So I will much prefer the 10gb offered rather than the offering I have at the moment.
