    nice meltdown

If that is classed as a meltdown, I would hate to live in your residence. I have seen hamsters with more aggression presented.

If you have the money to pay the debt then you should. Amex have done nothing wrong, they have lent you money in good faith and you would have been aware of the interest costs.

If you don't have the cash to pay it off why not try to come to agreement with them, ask them to freeze interest and come up with a payment plan.

Members on this forum are helpful and full of advise but deliberately walking away from your commitments will always get a negative response.

That you maybe a bit dim, not the sharpest tool in the toolbox. A sandwich short of a picnic. As much use as a handbrake on a canoe. Etc etc.

I have achieved a bit more than credit and zero-hour contracts in life, but do not be "worried jim" - your fellow established members on Money Saving Expert are here to defend you.

This must be great fun for the "Diamond Elite" members, I think it has been a while since someone has tried to shake the status quo around here.

If people told me to pay the debt, I would accept that. Instead, people have told me to pay the debt and then "stuck the knife in" since you love a figure of speech.

If I did not know any better, I would have thought the "Diamond Elite" members loved the opportunity to "start beef" where it was not asked for.
  • Pay your debts not run away from then.hoping Statute Barred comes into play.

Hopefully they'll track you down or whack you with a CCJ before the 6 years is up so it starts the cycle again.

Do you honestly think you're setting a good example to your family and others on here?

Settle your debts before making other big commitments.

There is one problem... the creditor would need to file the equivalent of a CCJ under New Zealand's jurisdiction, which, in the case of the signed credit agreement, has no legal validity outside of the United Kingdom.

Since I am not a British passport holder, I cannot be penalized whilst I am not residing in the country. As far as civil status, I am officially leaving the country with no attachment other than the one credit agreement with American Express.

As American Express do not include a transnational clause and me being outside the region of the Consumer Credit Act, the civil court in New Zealand would be powerless if means tested.

Since the debt is not included in the exempt types of debt, like council tax or fines, I cannot be prosecuted under English criminal law either. This also means I cannot be issued a warrant for arrest to bring me to the UK, as that requires an offence committed under criminal law, not civil.

My family do not involve nor knowledge themselves in my financial affairs, therefore I am not setting any form of example. My advice to them is avoid credit in all its preposterous forms.

As for the other people on here, I do not need to set an example nor owe such to them. My advice would be to use any legal loophole possible to "bump them off" and ruin their business, with the hope of them going bust one day.

    Theft is OK

As they say, karma is a !!!!! and one day you will get yours.

The massive corporations stealing from the desperate and foolish through constant compound interest is not considered moral theft?

I see all these posts on here about condemning payday lenders, but protecting well-known moral thieves like American Express and even sub-prime lenders like Vanquis Bank is a total contradiction. All creditors are out to make extra on their millions - moral thieves, end of story.

Since we are moving to New Zealand and have no plans to return to the United Kingdom within the next 6 years, we felt the option of "Statute Barred" being appropriate

You seem to think that running away from your debt and avoiding it in the hopes it becomes Statue Barred is acceptable?

For once, it's highly unlikely to work. Amex do operate in NZ and will continue to chase you and possibly obtain a CCJ in the UK courts. I'd expect that the UK and NZ will have agreements to allow enforcement of said CCJ in NZ.

As someone who highly despises the credit industry and has always maintained a mantra of "do not touch what cannot be afforded" - I do not feel morally guilty about "bumping them off" as it were.

You've been touching what you cannot afford; Over £9,500 of it!

If you run away without paying you are effectively stealing from Amex.

The only advice you will get is to pay. There is no legal loophole you can use to get out.

You could find that by not paying it, it could affect future Visa & job applications (where having no bad debt is a requirement; very common in the financial sector) and make life difficult if you ever return to the UK.

It's highly likely Amex will find where you live and chase you over in NZ.

You fit in well with rest of the thieving scum then. Moving to Australasia seems appropriate. ;)
