    If you note the red text in the link, it shows the words I used in the search box to find a similar situation to yours. If you ever want to find anything on the forum, pick out some key words and put them in the 'Forum Search' box, and change the default 'Show Threads' to 'Show Posts'.

    Received a package from BW legal: amended particulars of claim.
    I have scanned them and have them in my emails but how can I post them on the forum?

    Point 2. The claimant does not intend to rely on registered keeper liability detailed under the Protection of Freedoms Act 2012.

    If theyre not relying on the POFA to hold the Keeper liable, have they detailed a cause of action against the keeper? Absent the ONLY piece of legislaiton the ycan use, I presume theyll fall back on the rubbish CPS vs AJH films and Elliot vs Loake?

    They've alluded to the driver being an agent of the keeper and have suggested that the keeper is acting unreasonably in withholding the identity of the driver.

    I thought the final paragraph, (no 35), of the POC was original:-

    Where the claimant asks the court to come up with an alternative remedy if the defendant wasn't the driver.
