you have children?
i believe a court can order a AP to maintain a roof over thier heads till the youngest is 16
OP, you've completely ignored the above. Have you taken note of that advice?Pants0 -

I know they have a duty to maximise realisations, but I don’t know if they would expect you to pay all of the selling and all of the legal fees.
Bankruptcy does provide a way for people who are too far in debt to be able to get it off their backs and start again, there just isn’t the stigma there used to be about it all.
I think OP is hoping that all the costs will be put against her ex's share rather than 50/50 on the grounds that it is the OR that is demanding the sale.maxmycardagain wrote: »hold it...

It seems the court can't order the OR in the same way! Fine to demand an absent parent maintains a roof over their kids head, until the AP goes bankrupt and then the OR demands the AP's share.I'm a Forum Ambassador on the housing, mortgages, student & coronavirus Boards, money saving boards. Yes @silvercar changed my user name, and you are right in that insolvency law supersedes family law, the fact there are children is irrelevant the creditors come first every time. Just got to suck it up and get on with it, as hard as it is, loosing what I've worked for is heartbreaking, because of the way it happened, it's because of that I am struggling.0

If the house requires tittyvating to get a good price/best price/share out, tell Mr Ex you want £500 towards the costs, or a signed agreement of the split of money after costs, etc from the sale over the house 60/40 in your favourNow we all know how it felt to play in the band on the Titanic...0

I don't think Mr Ex is in a position to specify the split, as the OR is demanding Mr Ex's share! If threeofus could demand a better split that 50/50 she may be in with a chance of holding onto the home by raising the money needed to pay the OR.I'm a Forum Ambassador on the housing, mortgages, student & coronavirus Boards, money saving boards. Yes, sometimes
As you can see from this thread0 -
sadly it has turned my life upside down and whilst I do try to be positive his actions have meant we loose out, it is obviously more than the money issue but it's such a daunting prospect being kicked out of home with two children, just seems wrong0

Try to get the house sold as quick as you can so you can look forward to moving into your own place that you can call yours in a month or two. Then you can decorate and furnish it completely as you like and it will be yours.0
