Parking Eye Appeal - Request for more info

Hi All,

Before Christmas, ParkinEye issued a PCN because the driver overstayed 19 minutes in a carpark managed by this company with a maximum free stay of 2 hours (and no option of paying to stay for longer).

Maybe the appeal was not made fully right, but the appealed was based on:
1. Using two different areas of the car park but without leaving the premises, hence parking the car twice for less than 2 hours, instead than once for 2h19min.
2. Having made use of the installations. Unfortunately the driver only made one payment for £4 by card (all others by cash and kept no receipts), but this was just few minutes before leaving the parking.
3. The amount being disproportionate disproportionate when compared with any estimate of loss suffered by ParkingEye: free parking for 2 hours with no option of paying to stay over 2 hours, and charged £100 (reduced £60 if early payment) for 19 minutes !!!
4. ParkingEye is not the landowner so it should not have the right to enter into a contract with the driver.

ParkingEye replied asking for clarification about who the driver was. They say they have place the PCN on hold for 28 days so I, as registered keeper, can provide evidence, and, that 'if you have made or wish to make an appeal on behalf of the driver, and you do not provide the full name and current postal address of the driver, ParkingEye will be obliged to deal with the representations made in your name.'

Can anybody recommend what to do?
Should I clarify who the driver was or just wait for the 28 days and see what happen?

Other thing is... I think remember reading that ParkingEye has to decide on the appeal within 35 days (not sure if they are working days). It is now 28 days (not working days) since the appeal was submitted. Does it give any advantage on the appeal if they do not take a decision within 35 days from the original submission ???

    Forget the 35 days, as they have replied/asked for more detail, that will be good enough even if eventually the POPLA code comes past day 35. They are allowed to write to ask something.

    No, do NOT tell them who was driving!

    I am thinking you might have a 'Golden Ticket'? Search the forum or read post #3 of the NEWBIES thread about POPLA, where an example of a PE Golden ticket is linked. No POFA on the back?

    Unfortunately, POFA 2012 is detailed a the back of the PCN...
    I guess I still shouldn't say who the driver was and just wait to see what they come with after the 28 days... but should I reply telling that I am not providing the driver's details ??

    I've been told that after the 28 days I will still be entitled for the reduced charge.
    Would you recommend to pay it if the appeal is rejected? Or do you see chances of getting a win at POPLA??
  • Hi I parked at my local hospital to go for tests, I noticed that my ticket went over by five minutes so I put another 80 pence on the machine for an extra 30 minutes that it says on the board they have up. I put £1.30 they charge an hour but the ticket come out with only the £1.30 hour charge not the extra 80 pence I put in on the ticket so I wet to the hospital reception and told him, he told me that it should be ok but he told me to keep my ticket encase they do try and fine me glad I did as they have sent me a fine for £70 or pay in 14 days and pay £40 , I don’t think I should have to pay this I have filed in an appeal form. I would lile any help anyone can give me please.

    No, but use the time now to complain to the landowners. Is this a multi-shop retail park? Where?

    Go back & ask that the Hospital cancel it, or phone and ask for PALS or the Facilities Manager.

    Yes, it is a multi-shop retail park in Bury (Manchester): Moorgate Retail Park.
    I tried to find out who the owner is before appealing, but got no success...

    tomas, you need to edit your initial post to remove information about who did what. Only ever refer to The Driver and The Keeper.

    The Driver parked, The Driver paid £4, The Keeper received the PCN, etcetera.

    Parking companies monitor these fora.

    It's a few years old now (2013), but perhaps this brochure will help.

    There are two email addresses, together with phone numbers at the bottom. Surely worth an enquiry.
