If your salary is £45000 and you pay 10% pension, before tax is deducted, then your P60 would show your taxable pay as £40500. There is nowhere on the return you should show this type of pension payment

ok so its looks as if im in a world of pain, dug all my p60s out p11ds out today.
from feb 2016 ive been over the 50K threshold and i never did a self assessment for 2015/2016 I dont know how HMRC are normally but in the passed when they have adjusted my tax code then its always very quick and very letter but ive had nothing.
fast forward to 2016/2017 and im just trying to register for self assessment and i dont even know if this is going to be enough time to do it for the 31st.
I called HRMC and explained, the guy said i cant do anythign until i have the UTR code then once i have that it can take a further 10 days which he said the its unlikley to be before 31st so there will bea charge for that. He said best thing is to appeal against the charges explain that you whats happened etc and they could be leinent to you as you have contacted us.
I just have to wait (whch is the worse part) now and see what happens.Listen to what people say, but watch what people what people do!!0 -

You have no grounds to appeal against the (high income child benefit) charge as that will be based entirely on what you declare on your tax return.
If you are referring to penalties for filing a return late then maybe you should read the earlier posts in this thread. You always get a minimum of 3 months to complete the return so if it is sent to you today you have until the middle of April 2018 to fill it in before getting a late filing penalty. The 31 January deadline for submitting tax returns only applies if you were actually asked to fill one in by the end of October. Which it appears you weren't.0 -

OK thanks, I did a ton of reading yesterday on various sites and im still surprised that HRMC had never noticed (and still havent) that i hadnt completed self assessment and the guy said to me we would have caught up with you eventually so its alot better that you came to us and offered the information. So it looks as if I will have to pay the interest and fine for 2015-2016 tax year I'm read about penalties and interest charges and also something called suspended penalties and i guess im clasping at straws here and i guess that comes from making a hoenst mistake rather trying to get out of paying the tax or indeed claiming child benefit which ive already completed the form to no longer recieve the payments so im trying to show that i wasnt being dishonest
Suspended penalties
If HMRC give you a penalty for a careless error, you can ask them to suspend the penalty. They can suspend a penalty for up to two years. This means they do not collect the penalty now, but if they find any more errors during the suspension period, the suspended penalty becomes payable immediately. In addition, you will have to pay any other penalty due in relation to the new error.
If you satisfy HMRC at the end of the suspension period that you have met all of the conditions, the suspended penalty is cancelled and you do not have to pay it.
You can appeal against any penalty notice and ask for it to be suspended.
HMRC do not have to agree to suspend a penalty. The penalty must relate to a careless error (not a deliberate error) and HMRC must be able to set specific conditions attaching to the suspension and believe that your behaviour will change. This means that if another error cannot be avoided through, for example, an improved record keeping system, HMRC may not suspend the penalty.
I'm hoping i will fall in to the unprompted disclosures as per below (maybe wishful thinking)
What are unprompted disclosures?
An unprompted disclosure is where you tell HMRC about an error before they have started any enquiry into your tax affairs and before they have told you that they are going to inspect your records.
How do I minimise my penalty?
The percentage of the potential lost revenue depends partly on the type of behaviour (careless, deliberate, deliberate and concealed), partly on whether your disclosure is prompted or unprompted, and partly on the quality of the disclosure. This means the penalty can be reduced if you:- tell HMRC about the error;
- help HMRC work out how much extra tax is due;
- give HMRC access to information to enable them to check your figures.

just to follow up that I know its the responsibility of the person but how would any one know to look or even to complete a self assessment form if they work for company that sorts out the tax and pension contributions even before they have recieved there wage i kn ow it sounds like im blaming everyone but myself but theres being responsible and then there is completely unaware this rule exists.

Suspended penalties doesn’t apply, you haven’t made an inaccurate return.

The child benefit changes were well publicised. If you’re claiming benefits it’s not unreasonable to expect you to look into any relevant changes announced. They don’t accept ignorance of the law as an excuse.0 -

I know what your saying but I didnt realise it had changed and i can see from google some newspaper reports in 2013 but back then i was earning much less and in the space of a few weeks i went from being below it to above it without even knowing about the rule. however i have spoke to HRMC on webchat earlier and the lady has told me (probably incorrectly) but i have in writing that that i have 3 months for both tax years. That doesnt soud right but i will definately include the webchat in my appeal

What about it doesn’t sound right? She is confirming the same as you’ve been told here, you’ll get 3 months to complete the return before any late filing penalties are charged. However you may receive a penalty for failure to notify (she states late registration). I’ve provided you with a link to these penalties.
Interest will automatically be charged and can not be appealed.
There may also be late payment penalties but I’m unsure how this will interact with other penalties.0 -

oh i didnt realise i would have 3 months for 2015/2016 year i just assumed that as that year had closed then i would get a fine for that up until the form has been submitted and accepted.. As soon as i ended the webchat i didnt ask about the interest charges, and she never mentioned them so just trying to get a feel for what it will cost as a family holiday will not be able to happen by the looks of it.Listen to what people say, but watch what people what people do!!0 -
apologies for asking these questions.... just realy worried how much etc this is going tobe. I went on the webchat again and was asking about interest which i will be charged but they have no indication until the form has been submitted
I asked how much roughly and he said
The interest rate is between 2.5% - 3.00% at the moment over 365 days but we work it out daily
I think we have to pay back at least £1500 for 2015-2016 and at worst case its 3% (i'd love a bank account that pays 3%) is that 3% of £1500 = £45 per day! or total and I know we didnt have the 1500 for the whole 365 days but im just looking at worse case at the moment. Surely can't be £45 a dayListen to what people say, but watch what people what people do!!0
