Would you be referring to the Owner Manual? If so, OP should be in the clear as it states Oil level should be checked when re-fuelling. OP can then argue that - as they had only travelled 400 miles, they had yet to fuel up and therefore were not due to check oil level.

Just for info, when I bought a new car in July last year. I was taken to the car and shown how to fill windscreen washer fluid, Ad Blue fluid, and use the On Board Computer to check oil level and tyre pressure. This will all be in the Owner Manual but the garage made a point of showing all customers how to carry out these checks.

OK how many miles has the car done since you brought it?
what sort of driving were you doing before the day the car broke?
what sort of driving were you doing on the day it broke?
if you were using the car to go to the local shops, on weeks before but on the day it broke its the first time you used it on the motorway,

I agree that you should not have driven the car after it broke.
Did you have AA or RAC or something similar?
how did you buy the car? was it cash or finance?
We may not win by protesting, but if we don’t protest we will lose.
If we stand up to them, there is always a chance we will win.
