    I would ask for another examination, I remembered when I had my accident my GP at the time wrote this massive report about how she had seen me and the pain that I was in - I refuted it with my solicitors as the dratted woman saw me for precisely 3.5 minutes (I know because I timed it and noted down the time) she came out with a complete fairy tale about the length of time I had been in her surgery. I changed my GP after that little episode.

    Just a thought, I don't suppose you reported the accident to the police at the time? Mind you, it might be too late now as they'll moan that you failed to report an accident.

    The thing is i only had side and front damage to my car, the bump to my rear was so slight as i was moving at the time, and didnt even realise he was chasing me.
    I called 999 as he got out the car and was punching my windscreen and shouting at me, they attended but said that they wouldnt deal with it, and all they could do was have a word with him about his behaviour. They also noted on their notes that i was too scared to get out the car but solicitors will only treat it as a RTA.
    Thnx, i've got to go back to the osteopath tommorrow so i'm gonnna ask him a bit more about my injuries etc.

    I would speak to the police again, they may be more helpful now that you can point out the injuries you received. I would also consider writing to the Chief Constable as it seems ridiculous for the police not to deal with the situation in a better way. As for the solicitor, see if someone like the national accident helpline will take the case - its worth a thought. I had to deal with one solicitor in the practice where I was sent by the RAC and I didn't think he was much cop so I wrote to the Senior Partner of the firm and asked for a different solicitor - in the end I got someone else and it was she who advised me about claiming all expenses the other one didn't.

    Mention it to your insurers that the police attended and took notes - those notes could be very helpful.

    Take a look at your policy wording. It should indicate what is covered and what choice you have in relation to solicitors.
    As an example, page 30 of this More Than motor policy indicates you can select your own solicitor providing he only incurs fees with their agreement. You are not forced to accept their choice.

    Just spoke to my insurers and they said i have to use their solicitor as they HAve and agreement on cost :rolleyes:
    I just spoke to the solicitors and i hae to put it in writing why i dont agree with the medical report and i'm deffering until april 2008.

    you are entitled to instruct your own solicitor - if they refuse go to ins ombudsman.

    seek out a local one - there are plenty!!

    Well apparently it's defianately going to gop 50/50 now, so theres not much i can do on that front.
    I've been signed off work another month and refered to the back pain clinic by my doc, who i think are just fobbing me off.
    I still havent sent back the form to the solicitors yet, my osteopath said not to rock the boat as regards to disputing what the medical examiner done.
    He said that he more than likely put down a standard report like he does for most as there is no way on god earth could he take full history and examine me in 5 mins.

    If i just sack my solicitors off and go with one fo these no win no fees companys will it predgudice me?
    I'm really have no clue about these things, and really dont want to be stung.

    You need to speak to your insurer and solicitor to check whether you will get anything now for your personal injury, as you can ony usually claim if it is a non fault accident and you are now settling 50/50??? You could end up with nothing for your PI

  • Broke my finger in 4 places after a motor bike acciedent, which the other party has addmitted liability, that resulted in 3 days in hospital and a 4 hour operation to have screws and plates installed. I was off work for 4 months and only returned on light duties. I have a large scare. The solicitor has recomend that I ask for £1700 compensation which I believe to be well under for the pain I have sufferd. Has any one had any simular claims? or were can I get this information from?
