    They state that POPLA pack and the paperwork sent with the LBC amount to a hard copy of all relevant documentation as far as they are aware.

    Until you've received court papers, you've acknowledged them, you've submitted your defence and you've received the Directions Questionnaire (DQ), you're nowhere near a court date.

    That will come after you have completed your DQ, where you are able to provide dates when you will not be available for any hearing.

    You're a long way from your 'day in court' (if it ever comes!).
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Ok thanks for that and do you think that my previous comment would make it pointless to ask for a SAR ? ie if they have given me all they have?

    A SAR is free so do it anyway. Then you KNOW you have everything.

    Had another intimidating letter along with a print out of some of my posts on this forum.
    If this is likely to cause anyone any problems i will refrain from posting although i am of the opinion that it is my choice who i take advice from. I will give further details if no one has any objections.

    So basically my SAR is considered to be" manifestly unfounded and excessive"
    ".All information required in accordance with the litigation process and pre-action protocols have been provided"



    "We would be within our rights to refuse your request on this basis" There is a link to their privacy policy which sets out the basis for charges dealing with SARS which are manifestly unfounded and excessive.
    In this instance they will be prepared again to undertake a search for a fee of £30 for time spent and also require me to provide a list of any vehicle registration numbers associated with my data and proof of, ie V5 logbook!


    Wasnt this provided by the DVLA?
    I am informed of my right to complain to the ICO.


    I am informed that this week county court claim will commence and "it is intended to rely on this correspondence as further evidence of the unreasonable manner in which you are seeking to conduct this litigation"
    Bit rich really, considering their lack of transparency has instigated this!

    A print out of posts from the forum is enclosed , and claims i am following dubious advice. I am advised to take proper legal advice.
    Cant believe what i see on this forum , i consider the advice to be supportive and its an individuals choice wether or not to take the advice.

    To refuse a subject access request, they need to provide the reasons to justify their decision. Considering they are trying to extort you for money, it's entirely justifiable to make a SAR to get a complete set of personal data for your case.

    I doubt the ICO would consider £30 to be a reasonable fee either, considering the previously permitted fee was £10 pre GDPR.

    A complaint to the ICO about them may be in the offing.
