To answer the question. If you have proof of a default date from the original creditor and can 100% prove they are the same debt the you can write to Max Recovery enclosing a copy of said proof and ask them to change it and update the CRAs. Bear in mind most organisations update CRAs monthly or 6 weekly, it may take 2 months from acknowledgement to update.
If they refuse, then write again giving them one more chance before you go to the ICO.
Do not threaten the CRAs as they can only process information given to them by creditors.

I'm currently dealing with the Financial Ombudsman Service over MaxRecovery.
I have raised a complaint with the CRA Noddle and shown an email from the original creditor stating the correct default date should be 1st June 2012.
Be interesting to see what the CRA comes back with.0
