    How can they possibly state, if YOU appealed (a chap) that you were driving, when you have told us it was your wife? Do as nosferatu1001 says. Reply saying you are interested in their unequivocal statement about the driver and you now require that evidence by return, and will complain to the Information Commissioner if they have such footage/photographic evidence of the driver, but withhold it.
    So is it now a case of waiting to see if they take me to court?
    Always is, with an IPC member, because they don't cancel unless the landowner tells them to. Seeing as complaining to the landowner is the first thing the NEWBIES thread tells everyone to try as Plan A, before any appeal, we assume that's already been exhausted, if not, why not?
    At what point would a debt collection agency be allowed to get involved?
    Now (well soon) to send some daft threatograms! So what?! That means nothing is happening.

    What are you envisaging that debt collection letter-writers can actually do? Please don't say knock on your door, act like a bailiff, clamp you car or steal your cat, etc. This stage is nothing and is covered in post #4 of the NEWBIES thread, which tells everyone to ignore debt collector letters (unless you move house, in which case advise the new address in writing, while denying any debt or liability).

    Nothing to worry about.

    Even if they try a small claim, we win 99% of the time when people are fully coached here.

    Also I have appealed for my wife, but using my wife’s email address ect, so basically I have appealed as my wife. Should I still ask for the evidence and complain to the information commissioner if not provided?

    My wife is the keeper of the vehicle, there is nothing more to that, the appeal has been sent with no admission as to who is the driver, there is not a single post on here that states my wife!!!8217;s name or indeed my real name, how can any conclusions be drawn from what is posted on this thread? In regards to myself, I am neither the driver or the keeper, everything I am asking on here is on behalf of the registered keeper of the vehicle

    I now understand your point, but using that as evidence is clutching at straws isn!!!8217;t it? How can what is posted here be linked to the identity of the keeper of the vehicle in question? I don!!!8217;t seen how that!!!8217;s possible as no personal information has been given here

    If my wife complained to the information commissioner for not providing the so called evidence she was the driver, exactly on what grounds would she be complaining ? I’m guessing if they have the evidence they will ask for an administration fee?
