Thanks for the replys, i would just like to point out when i did the appeal to POPlA there was no option to send any photos or diagrams showing parking spaces, i did ring them to tell them i had this evidence but was told you can only appeal in writing, no pics or videos accepted so at a loss

    And the newbies thread says this;
.....but don't feel you have to answer their questions, you should write a detailed appeal and attach it as a PDF along with photos (use the parking firm's own photo of the sign if the words are illegible and the £100 (or whatever) charge is not in LARGE letters. Certainly don't blow it by trying to answer 'what happened' just because POPLA questions prompt you to answer! .......

For who are parking eye acting for?
in other words who has allowed parking eye to set up on the land?

If you have to traverse through a parking eye infested piece of land, I would assume you have an easement/right of way over the land to pass/re pass without let or hindrance?

If the above is true then it matters not one jot what POPLA say.

It may be of use to provide a location of this car park so others can see

Put the HHTTPPSS etc in front to see pic

This is a pic of out carpark and business/residential layout

The red circle is where the camera is located, one point north to the entrance of the 30 min slots and on the same bracket the 2nd camera facing south out of the 30 min only park slots.
The rest of the public parking is for 3 hours, the red line shows the route i have to take to my private parking space.
There is another camera on the wall just before i go under the carpark on the building to the right of our private parking.
The idea is when you come in it records you coming in then when i pass the camera on the building next to going under the carpark it records you going out so in theroy you are no longer in the carpark, and its the same coming out, the cam on the building sees me coming into the carpark and the one in the 30 min slots records me going out. but for some reason the one facing north has picked me up coming in and the south facing has not recorded me going out, when i have gone out later its not recordered me going out but only coming back in some 2 hours 42 minutes later making it look like i have been in the 30 min section for 2 hours 42 minutes

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Assessor summary of your case
The site operates Automatic Number Plate Recognition cameras (ANPR), the operator has provided photographic images of the appellant’s vehicle, AP13 FWM, entering the site at 09:45, exiting at 12:31; the period of stay was two hours and 46 minutes.

The ANPR images provided by the operator show that the appellant entered the site which is for retail customers, and hotel residents only, and remained on site for three hours and 46 minutes, which is 46 minutes longer than permitted.

Clearly an Assessor who can't count!!!

So are ParkingEye working for Travelodge?

If so, you need to complain to them and get your reg number on the white list.

ANPR setups are notoriously inaccurate, especially in what is known as Double dip situations, where one, or more cameras does not record and exit/entrance.
While you should avoid court where possible, read this from parking prankster on a double dip case http://parking-prankster.blogspot.co.uk/2016/12/excel-lose-double-dip-case-at-peel.html

    What you should do now:
Check your rights to the space, and in particular access rights to and from the space

Find out what entity has contracted parking eye, it looks like it could be the travelodge, but it could be the retail park owners.

Once you have established your rights, you will need to contact the land owner ( retail park/travelodge) and inform them that:
your rights to pass freely and without harrasment are being obstructed by parking eyes camera systems
that they are liable for the actions of their agents
That their agents ( parking eye) have no just cause to access and process your data
And you expect that any obstructions/devices that result in you not being able to freely pass to be removed with immediate effect.

Do not accept your vehicle being added to a whitelist, if you or a guest ends up in another car ( ie hire /courtesy car after accident) you will end up with a whole heap of issues should parking eye try their tricks
The only acceptable solution is the removal of the obstruction

Also if you have rights to pass/repass without let or hindrance then each time parking eye access your data they Wil be doing it with no just cause, if this is causing you stress/worry then you may have a valid claim for a data protection act to bring against the landowner and parking eye jointly.
