Please help a friend has pulled out of the booked holiday

    There are 2 contracts in place here.
    As the lead passenger, you have a contract with the travel agent and the other two people who were going to go on the holiday have a contract with you.
    There may not be anything between you and the other people written down but this doesn't mean that there is no contract as contracts can be verbal.

    I realise that what would happen in the event of someone pulling out probably hadn't been discussed prior to it happening but IMO passenger C has breached their part of the contract by not paying in full and as such, they could be liable for any direct losses incurred because of this so I don't see why the refund obtained shouldn't be used to pay for the extra cost for you and the other person who still want to travel.

    If you do this, passenger C could take legal action to try to get their £120 from you but personally I can't see it happening.

    This is what I stated in my first post. If she chooses to pull out and it will cost A & B an extra £60 each, that covers her £120 remaining and she gets nothing.

    Her alternative is to bury the hatchet and plan for a pleasant holiday.

    Use this £120 to cover the increase in the holiday price for passengers A & B (£60 each) so the only person to lose out would be passenger A.

    She won't like it but it was her decision not to travel so why should the other 2 passengers lose out because of her choice?

    That would be my thinking too.

    It is not clear what the room and sleeping arrangements are, but generally hotel rooms are designed to accommodate two people comfortably and three can be cramped. Often a third bed can be a sofa bed or a camp bed more suited to a child. Passengers A and B need to consider what they will benefit in terms of additional comfort and space if only two are going. They may well decide that is worth an extra £60 each.

    Assuming option 3, passenger C appears willing to accept the refund of £120 to be removed from the booking. The risk is if she receives nothing she may decide to go anyway. This could ruin the holiday with arguments and an unpleasant atmosphere.

    Your thinking is that passenger C will pay another £200 to go on holiday in order to argue.
    That doesn't seem a likely scenario.

    We got a very good deal on a superior one bedroom apartment that can sleep up to five - this was because at the time we were potentially going to be adding extra people although this fell through but the deal was good and we decided to book as it is very spacious.
