Help and advice please :-Been taken to county court for £15 ! yes £15

    Paypal and Ebay would both have emailed you both about the returned payment and every time the seller sent a message so I find it a somewhat tenuous claim when you say you've not had any correspondence over this.

    The seller is also not psychic so didn't know they were selling to a sole trader. Many people, myself included, have Ebay purchases sent to their workplace so a business delivery address also doesn't mean its being sold to a business.

    Contact the seller and negotiate a method of payment with them and an amount which will cover their costs to date and ask them to cancel the court claim if you pay. That'll be a lot easier to resolve than through county court.

    As for taking someone to court over £15, as an Ebay business seller with five figure feedback I got sick of people trying to scam me as well and for some reason more seemed to try to do it over a £2 item than a £1000 one.

    I have not said I have not had any messages, but these where first discovered on the 24th of December.

    The seller could of sent me a letter, at the cost of a stamp as part of the legal protocol.

    Not everyone logs into their ebay account everyday, I have 6 different accounts.

    2 for selling and 1 for buying and the others as spares.

    But also the seller should not be presumptuous in assuming I am a individual or as a business / sole trader.

    I feel it is quite unfair for a sellers poor abilities in respect to been able to process the correct payment.

    Sadly as a eBay seller with over 23,000 feedback on my main business eBay account, I kind of feel his pain.

    But alas their own lack of abilities, is not or should not be my problem.

    The seller made an initial mistake, but the lack of "abilities" after that point are your own.

    So you didn't check your email for over a month, but you would check your post. Whelp, you've asked for it really, next time check your email, and be glad that you are learning that lesson on the cheap.

    You failed to check your email, your ebay account, your PayPal account and your linked bank/ credit card account. Who else do you suggest is responsible for doing those things?

    Contact the seller and see if you can resolve the issue before the small claims action is issued. Be polite and accept responsibility for your errors, you're far more likely to get an amenable response with that approach.

    Thank you for your reply, regardless of me checking the emails, the business seller based on my understanding has not followed legal protocol by sending me a letter explaining the situation and giving me 30 days to pay.

    Which sadly is not my fault. ]

    And that is how 15 pounds turns into a lot more, potentially also into a CCJ - by ignoring advice of people who know better. You really were hoping to get over the seller, my doubt about it is gone, and deserve it.
  • Sadly your opinion is incorrect , I am happy to pay the seller , but I am not happy to pay a £25 premium , so if that means if the seller is playing a game , he has to play by the rules.... a letter and following protocol for a business debt , as he is a business seller , would of been the better route to follow.

    The seller raised the stakes with a fee that is higher than the original payment .

    Are you going to outline to the seller that they haven't followed procedure and give them the option of resolving it?
