So while I wait to hear back from ASDA do I submit my POPLA appeal? I've tried to follow advice on the newbies thread and it was all about sending a long winded appeal to POPLA like the one I've put in here. I've been advised that point 2 is not applicable so I shall remove that, but what about the rest of it, will it be much good? Coupon has advised PE usually win POPLA appeals in which case I'd be liable to pay the full amount - I need to submit this soon if I'm going to do it, would you ever advise it better to just pay up at the lower rate? I'd be really annoyed if I did but at the same time if they usually win POPLA and Asda aren't going to help me (they may or may not) I don't want to give PE even more of my money!0

Absolutely NOT until the POPLA code is at day 32 (latest) from the rejection letter.
Your chances of getting it cancelled by Asda reduce to nothing once POPLA starts because PE will bleat it's ''too late'' (lie).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok thanks, and what about just paying up at the reduced rate (as I think I only have 14 days to do that and its about day 11 now)? To reiterate, I don't want to pay, it will be highly galling - but I also don't want to end up giving them even more of my dosh if Asda and POPLA fail!0

If there was a reason for the overstay (very busy store at Christmas/sales, for example) or a medical reason why an occupant of the car needed more time, AND the driver/passengers spent money at Asda, I can't see why you would fail to get it cancelled. why would Asda want to lose your custom?
I would NEVER tell a person to pay this scam, you need to watch the MPs condemning the industry. They named and shamed Parking Eye, watch it (post #41, The Deep gave you the link, you won't regret it and I hope it will inspire you to complain to your own MP as well, before trying POPLA.

Ok thanks. Unfortunately I have no proof of the driver shopping in the store or medical issues. The driver noticed the car park was half empty on arrival and 80% empty on departure, as it was an evening visit, but to me that says the store didn't need to enforce the restriction, and should only do so during busy times. A lot of supermarkets operate a barrier system when busy but when not busy just leave them up.
I absolutely agree this is a scam but unfortunately our esteemed legal system seems to be supporting parking firms in being able to enforce the charges. *sigh*
Can you tell me if MP and ASda appeals fail and POPLA fails, is there any further redress before going to court or am I pretty much sunk at that point?0 -
If asdA and popla fails it doesn't follow you have to pay!!0
