UKCPS PCN but with terrible photo

Hi everyone,
after reading through the sticky thread i was just about to follow the advice and put in an appeal using the template provided. However on the PCN, the photo of my car is terrible as it was late at night (5:35 saturday afternoon) so the sun was down and its on a small ally way. So in the distance photo, my car can hardly be seen, however they have the other photo of an up close of my reg number.
So does this mean they don't have a leg to stand on?
Also on a side note, the whole reason i have started parking here is because i go to a near by gym and we all used to use tesco car park as it was free for 4 hours, but no the council have started to charge £1.70p/h, so this would quickly add up over the month. So i asked around the gym for where other people were parking and some one told me about the alley. i asked about the signs on the wall but they said that have been parking there for a while with not issues from UKCPS so we assumed they were old signs and to be ignored now. So long story short, if the council had not screwed up our free parking, i would not be parking there in the first place.
this has also resulted in my gym losing over 800 member because they have no where to park.

no idea why people think a parking company dont have a leg to stand on , its an unregulated industry where "anything goes" and they are all called parking cowboys for a reason
they issued an invoice for payment due to perceived rule breaking
yes the photos should prove their case or fail if they dont, but unless it goes before a judge in civil court you wont get a legal answer to your questions or queries
if this is private property with signs up then it does not matter what happened at tescos or the gym or with the council, they are all irrelevant
if you dont have a landowners permission to park on their private land , then dont - its that simple
yes use the template , but its only a paper exercise , they wont cancel and you have fallen into their trap and they have 6 years to harass you and take you to court (MCOL)
its a trap and you fell for it , so learn from it0 -

i understand what you are saying. I have no idea who owns that property however its on a shopping high street so i can only assume its the council. And since i pay road tax and the rest, does this not give me the right to drive upon their land just like the other million people.
i will send appeal off and see what happens.
Most people on here seem to give the advice of just ignoring the UKCPS company, however you have now lead me to believe that i should not do that and that because i parked somewhere without a permit that they have the right to charge me £60-£100 for 2 hours parking.0 -
Well a court might find they do, that's the realistic truth.

i have put in the appeal.
however if i lost the appeal does this mean that if i want to just pay the fine to stop all the hassle that i will then need to pay £100 as it is over the 14 day period.
as if it is, i think id rather just pay the £60 no and just forget about all the BS and don't park there any more.0 -

the fact that a private company has ticketed the vehicle meakes ME assume that it is private property and not under council control and nothing to do with paying road tax
you can check with the local council to see if its "their" road or not
I ASSUME that it is NOT their road and that council laws and vehicle tax play no part in this
I assume that it is a private road or private land because UKCPS are ticketing vehicles and they are NOT ALLOWED to do so on a public road that is adopted by the council and subject to council laws
you dont need "road tax" on private land , just on public roads
and NO , you do not have the right to enter private property with your vehicle just because you pay "road tax" , but although you may have the right to DRIVE on that land , you do not have the RIGHT to PARK on that land
you can pay the Land Registry about £3 to find out exactly who owns the land, if the council cannot help you
I agree that it is a good idea not to park there any more
but either way they still sprung their trap on you and you may need to go to court for non-payment of this invoice (its not a fine) if it remains unpaid

I've called the council today and by the sounds of it, it is there land, however the guy did say that they hire private companies to enforce their land. So it did sound legit from what they were saying. I know tesco do own a part of the land near by, however i from what the council guy saying, they own that land.
Coupon-mad, i wont pay the fine if that's what the rest of people do as i so want to stop these types of companies screwing people over and trying to make money from mostly innocent people.0 -
If it's Council land then you need to get proof, and report UKCPS, because they never work for Councils, and if they were then the PCN would be a real Council 'PENALTY charge notice'.
Get the proof like here where UKPC (not the same firm) are allegedly playing a similar illegal game:

If you can find proof from the Council (see the right questions to ask after Christmas, on the linked thread) then you should report UKCPS to the DVLA, who will take it seriously (and IPC, but they are unlikely to do much IMHO) and your MP and the Council Highways Dept, and Trading Standards too!

also bear in mind that coucils can be a landowner and yet rent out the land to a third party who then employ a private parking company to monitor the land and issue tickets which have nothing to do with the council at all
for example , in chorlton , near manchester, tameside council own some land at the back of the shopping precinct that excel monitor and issue parking tickets on, yet the council have no involvement at all even though they own the land
its a convenient way of passing the buck and of them all making money at the expense of the consumers who use that car park
