Title plan

Hello, hoping for some advise about a tile plan. We are buying a new build property and the solicitor is asking us to sign the title register, but the plan isn't correct. The plan provided includes two other properties.I believe this is because the original builder brought the whole plot shown on the plan, redeveloped the two existing hoses and sold them and then sold the corner plot to the builder who has built the house we are buying. Am I wrong to expect each property to expect each property to have it's own plot as they are freehold? Has anyone had a similar issue? I'm not getting any answers from the conveyance firm. Thanks very much.

    The title plan should match what you are buying. Instruct your solicitors to get the vendors solicitors to sort it out.

    Check with your conveyancer, but it's a new build so there is no title plan for your property at the moment. I'm presuming that there will be a new title number assigned to you on completion. Have you had the Transfer to sign? Is it a Transfer of Part i.e. a TP1? That would indicate that a "part" of the original title is being transferred to you and once you have completed, the conveyancer will make an application to the Land Registry to register the Transfer of Part, i.e. the plot you have bought, with you as the new owner. You should then be given a registered title and plan in your name and the plan would reflect the part you then own.

    When they sent you the information, they should have asked you to carefully check the plan to ensure it corresponds to what you think you are purchasing, and inform them immediately if it does not.

    Your actual plot is usually marked in red on the plan.

    May be time to consider a new conveyancer. This is probably the most expensive thing you have ever purchased, and it is important you have appropriate, expert support to ensure it all goes smoothly. If your conveyancer is not helping you on this simple issue, you should be very worried what else they may be missing.

    A TR1 is a Transfer of whole so I'm assuming the property you are buying is already registered under it's own title.

    But you refer to a plan including two other properties - so is that a title plan bearing the same title number as the register/title you are buying and/or are the 3 properties all edged in red for example?

    It's important to match plans/registers/Transfers as appropriate and I wonder if the plan is actually from an older deed/title for example so may relate to earlier dealings with the whole site?

    Thank you for replying, All i three plots has been outlined in red, I don't understand why the plot hasn't been separated in to three already as each part has been sold since the original builder purchased the plot. I'm still waiting for the conveyencer come back to me :(

    It reads as if you may be looking at a deed plan rather than the title plan but can't be sure from details posted to date.

    So it is up to you to check the Title & Plan being transferred to you and inform him if it does not correspond with the property you have viewed and chosen to buy.

    Go in and see your solicitor.

    Reading these threads, I endlessly wonder why people choose slightly cheaper online/remote conveyancers.

    Yes, when all goes well, you save a few £s. But when issues (like here) arise, you cannot beat face-to-face explanations.

    There's moneysaving, and then there's risk and false economy.

    Choosing a solicitor isnt a guarantee of things going right. My solicitor-that-turned-out-to-be-a-legal-executive did exactly the same thing (as well as leaving various other things to be desired in the level of service they didnt provide).

    That being they didn't explain (or even mention) the difference between the deeds (which show me owning another house as well - which would be fine by me:D - but I very much doubt it...) and my modern day title plan which shows only my own property.
