Online food order rights over use by date.

Hi,

I ordered from Iceland for the first time on Saturday and it arrived on Sunday night about 8pm. I was putting the kids to bed, just shoved the fresh stuff in the fridge and went back to putting the kids to bed, and only realised afterwards that there was a problem. When I unpacked an hour later I noticed that the bananas were bruised and one was split not looking particularly fresh. I also noticed that the fresh raw chicken was use by the following day, I couldn't see any life guarantee on the meat I'd ordered and so assumed that it would be about 3 to 4 days, I couldn't have used it by now. I also noticed that the cooked chicken I had ordered for my son's packed lunches was up in two days, I can't use it by then! What are your rights when ordering food online where no best before is stated? I have emailed them asking for a full refund and someone to collect the three items at a convenient time as I wouldn't buy things with such short shelf life in store, can I expect this as a consumer?

    No idea about consumer rights but can't you put both lots of chicken in the freezer till you need it, split into smaller portions if nevessary?

    Pedant alert - it's could have, not could of.
  • You should be entitled to a refund for the bananas as they were damaged but that would be it.

    As long as any items with a use by date are delivered before this date and there are no use by guarantees given then the retailer hasn't broken any laws regarding this.
    It's not particularly good customer service but it is legal.
  • They can only bring the dates they have in the shop. There are no "rights" unless they've guaranteed the dates beforehand.

    Would never use online shopping, I know somebody that is a picker and they're told to use short date items that physical shoppers would decline.

    That would be a bit stupid since all the supermarkets who deliver will usually refund things you're not happy with anyway.

    Sainsburys, Tesco and Asda definitely don't do this so if your friend works for one of these they should report the manager for telling them to do this.

  • Hi, thanks for all the replies. I rang Iceland and complained they've offered a full refund for all three items or to send out replacements for them all. The lady on the phone said it's their policy that everything they sell online should be ok for 2+ days so effectively it's a three day use by date. So I've still got the stuff to use and a full refund, I'm happy with that! Going to bake banana bread now!

    I didn't say they weren't good enough to use, I said they weren't the standard that I expected, one was well beyond use and several were bruised.

    I have two children with autism and they will not eat food if it doesn't look the way they expect it to or if the texture is different, so if a banana is brown they won't eat it.

    I bought them for my children's pack-up for school not to bake with. I shall have to find time during my dinner half hour tomorrow to buy some more.

    Iceland suggested that I try and use what I can and throw away the ones that weren't edible. What would you rather me do throw them all away? I'm quite surprised by your response!

    And don't be surprised by that sort of response either, unfortunately on these boards you get a lot of people who only want to have a go at the poster.
