NHS Parking for staff

Hi all,

I need some advice on this. The o/h is in dispute with a solicitor acting on behalf of her employer regarding the display of a parking permit.

The charge is for £25, increasing to £50 after 2 weeks, and then court.

The car park signage says the pass must be displayed clearly in the vehicle. It was albeit not in the windscreen where they are expecting it to be. The solicitor also says that they are not regulated by POPLA, BPA or IPC but are under government regulation. What does this mean?

We’re now at a stalemate where they say the pass wasn’t displayed clearly (it was) and us saying it was displayed in accordance with the signage which states “a valid permit, ticket or other form issued by [the authority] MUST be displayed within the vehicle at all times”.

They then say that “The attendants do not have time to search every car looking for permits which are not clearly displayed and as per the photographs that you were previously sent, yours was not clearly visible.”

The photos show the front and rear screens.

Clearly the parking attendant’s negligence doesn’t make the o/h liable for the charge. But where do we go from here?
