    Do exactly, and only, as advised, by c-m (esp. #5)and other trusted posters here. Your correct course is clearly laid out.

    C-M, I think you must have missed this bit in the OP's first post:
    I have had a letter from Gladstones solicitors threatening court action to someone who is not me concerning an unpaid NCP parking ticket for car I do not know

    ... So any Court Claim or CCJ will be against this unkown person who is not the OP. Sending back letters addressed to someone who doesn't live at your property, marked 'Not known at this address' seems like perfectly reasonable advice to me.

    thanks all - yes I have been on this site for ages plus carpetbaggers before always a great help!

    Yes the police said opening a letter addressed to someone else is actually an offence so send them back. Then the real person will have a trace put on them (which is what NCP promised me back in July 17).

    I contacted the person at DVLA as suggested above but had no response. Also the solicitor and NCP so can't do much more.

    Also the MSE exparian check says my credit is still excellent so no harm there!!

    So feel much reassured now thanks all and a very happy Christmas to you all. Now off to catch that elusive flame deer!!

    It is not illegal to open mail addressed to someone else.

    It only becomes an offence if "intending to act to a person’s detriment and without reasonable excuse".

    Postal Services Act 2000.
  • Write to the solicitors in brief and clear terms, referring to previous correspondence:


    Dear Sirs,


    I am the owner/resident of xxxx [address]. You have sent various letters to this address, to a person [name] who does not live here and never has, as far as I am aware. The letters concern vehicle registration number [xxxx]. This car does not belong to anyone residing here, and never has done as far as I am aware.


    The local police have searched their data base and have informed me that the car bearing VRN [xxxxxx] is not registered to this address. It appears that DVLA made a clerical error and have given you the wrong information.


    The police have advised me to return unopened any further communications from you, marked "addressee unknown". Please contact the DVLA to resolve their error and cease writing to this address forthwith.

The DVLA may wish their CIO to investigate further if the person incurring these charges is attempting to evade liability by inconveniencing us both.

    The DVLA has a CIO whose job it is to note where people are deliberately giving false names and address to the DVLA. Sometimes this is someone who has read it on the internet that giving a false address is a great way of avoiding parking tickets. It's not and the DVLA's CIO is there to keep it that way.

    PPC do pass on a lot of information to the CIO when they come across it so they will know what to do.

    Hi all thanks again! just heard from and the solicitor and good news.


    DVLA say:


    Firstly, I can confirm that your address has been removed from the record so you should not receive any further correspondence relating to this vehicle.

    Secondly, I have been in contact with the parking company to make them aware of the circumstances of this case. They have replied as follows...

    “I can confirm that I have spoken with our debt collectors (TRACE) and solicitors (Gladstones) and both PCNs have been cancelled. I have made sure they are cancelled on the system and the outstanding balance is now zero.”

    Therefore, you should also not be receiving any further correspondence relating to this parking charge.

    I hope this helps to bring the matter to a conclusion.
