please please help me

Hiya

I've tried to read through the new posts explaining whatto do with parking fines but as I have no idea who the person is they keep sending me stuff for not sure what to do now.

I have had a letter from Gladstones solicitors threatening court action to someone who is not me concerning an unpaid NCP parking ticket for car I do not know. Previously I rang both DVLA and NCP (at great expense on a mobile) to explain this and was assured by NCP they would put a trace on the person and cease action at my address. This can not be he case as I had the Court action threat letter today along with my happy Christmas cards!! I have no number for Gladstones and emails to them have not received replies. I have written but this might take ages in the xmas post.

Any ideas what I can do as I don't want to ruin my excellent credit rating.

    A car you've never owned?

    Complain to the DVLA about your data being wrongly released as you have never been keeper of that car:

    DAVID.DUNFORD@DVLA.GSI.GOV.UK

    Attach a copy of the letter(s) and insist this is handled urgently, as you are about to be used over a car that's not yours.

    thanks so much I did ring DVLA awhile ago and they seemed to think I had no authority to change anything as it wasn't my car. I'll try the contact you have many thanks!

    Write to Gladstones and tell them it is not your car and you wern't driving. Send this by email AND first class post. If they do plough ahead they could be in trouble having been given that information.

    No phone call. YOU MUST HAVE A PAPER OR EMAIL TRAIL FOR ALL THIS.

    URGENT email making it clear to Mr Dunford that you are about to be sued, and that you have already phoned the DVLA to report this and nothing was done, and you hold the DVLA liable.

    And email Gladstones too (as above) - claxtome posted Gladstones' email only last week on a thread, so search claxtome's posts.

    Suggest you go back to the DVLA by email and repeat the process. This is to get it in writing from the authoritative source which is the DVLA. You can then forward that onto both Gladstones and the parking company to explain they have made a grave error as the DVLA has demonstrated.

    Conversations are not worth anything and you could end up having hassle when a simple confirmation from the DVLA will do the trick.

    To assess the accuracy of its records, DVLA undertakes an annual Traceability Survey to estimate how accurate its records are. In 2015-16 Traceability Survey estimates that the accuracy of DVLA’s records at 92.6 (2014-15: 95.2%), against DVLA’s target of 95%. DVLA recognises the need to make

    Here's an update! I did all of the above and have not had replies from any of them.

    So I contacted my local police and they were so helpful and reassuring.

    They said first of all send any letters addressed to someone you don't know back 'Unknown at this address' then there is no further involvement.

    Then they confirmed from the car reg that DVLA have removed my address from the car so there should be no further problems.If any further letters arrive send them back - there is nothing they can do.

    They also suggested I contact a credit agency such as exparian to check my credit rating and if there is any problem to correct it.

    What, so the Police advised you to IGNORE AND SEND BACK letters, even if one might be a court claim? Whaaaat? And get you a CCJ for not defending? Whaaat?

    We want to hear what David Dunford at the DVLA says when you complain properly - edit I see you have. Good.

    Going to the Police was not the right thing and their advice was IMHO waaay wide of the mark, and will damage your credit rating. Gladstones already have your data, wrongly, from the DVLA so you MUST get that put right.

    The fact that car doesn't show you NOW as keeper, doesn't stop Gladstones. The DVLA will.
