To pay debt collectors or to fight

Hi all,
I think I posted about this a few years back but now it's finally got to the court summons stage. The debt collectors have given me the opportunity to pay £149 for an unpaid PCN outside of court, or I can go ahead with the court summons and I'm not sure whether I should fight or just pay. Please also keep in mind that £149 is more than a weekly income for me, so I couldn't afford to pay court costs if I lost, which is what worries me the most about fighting this.
So basically in 2016 I crashed my car - badly. I pushed it off the main road into the nearest car park (one that happened to be run by UK Car Park Management.) I managed to find someone to come and pick it up for me, but they were unable to get out till the next day. They did not issue the PCN to the car but sent it in the post. This was the same week as I moved house, so DVLA sent them the wrong address which they sent the PCN to. The post never got forwarded on to me so it wasn't until months later when I was sorting out another parking dispute that the debt collection agency also told me they had a collection for another parking (this one) to collect for. Obviously I was furious because I had never received the PCN, it was past the appeal stage and they refused to send out a PCN to my actual address so I had no information.

It is the DRP. They were the ones that told me it could be as much as £400 if it went to court. I'm just a bit worried because they said they have it on recording that I said I'm not paying it (which I did, I also said I hadn't received the PCN, they acknowledged this and I said I wanted to appeal it), I'm worried this will go against me.0

DRP are lying , they only get there cut if you pay up
DRP have never been to court , so how can they "guess" £400 ,
the ticket was £100 , not £120 , £140 , £300 or anything they make up its £100!!!!
cost of ticket , max £50 for solisitors , and court paper fees do not come to £400
if it gets to court , and you loose , takec heart in that out of the <£200 they get from you they will have paid court costs and at least £200 for solisitor

Google (or Bing or Yahoo if you prefer) frustration of contract. It is a defence if they are foolish enough to go to court.
It would be UKCPM who would have to take you to court, not DRP. so your call to DRP makes no odds at all in terms of you telling them you aren't paying it.

Fancy saying they have recorded you saying you will not pay.
We know DRP are full of rubbish anyway, but this caps

Thank you, this has definitely given me the courage to fight it in court if necessary. Thank you for all the links and the helpful advice
And I will now ignore DRP. Although I do think UKPCM probably have said they will be taking me to court we'll see how it pans out.

If you get a Letter Before Claim then post back on how to deal with it. Anything else is just threats.0
