    Can you please refine that.

    England? Wales? Scotland? Northern Ireland?

Somewhere else? If so, please state where.

  • Where in Britain?

The MSE regulars wish to hold their Christmas party there (or at least it is where we would like to park).

What fun we would have. A scary bunch....

  • I think I'd rather check myself into an asylum rather than be a clamper facing us lot!

Is there any outstanding finance on the vehicle that has allegedly been clamped?

I've got some pie leftover from last night if the OP would like some...?

The original poster needs to give a specific location, even an address.
if it was a genuine clamping event then there is nothing to hide and everything to gain in divulging the information.

As for clamping, its still possible ( though not legal) for a one man band type set up to posses a clamp and use it, quite a few people still believe they can be clamped, and by that logic quite a few people will believe they can clamp - places such as Pubs, local shops, community centres/places run by a committee would fall under the spectrum of we've put signs up in our car park to stop illegal parking and bought a clamp off ebay to fine repeat offenders
    From the Plain Language Commission:

"The BPA has surely become one of the most socially dangerous organisations in the UK"
  • Is it illegal to merely clamp...even if the clamp is removed pretty immediately and for no charge?? [I think the answer is yes]

Akin in my mind to 'blocking someone in' if they were to park on your land??

Both the above are in effect 'immobilising someone's vehicle'....

By clamping the car illegally, the clamper committed a tort of trespass against goods.

The remedy for that is to compensate the owner for the damage caused, in this case the cost of repairing the damage to his wheel. If that was my car, I'd be suing them for replacing the BBS Alloy wheel, which is about £400.

So not tenuous at all, and fully justifiable.

So the tort of trespass is the mechanism by which to make a damages claim. OK - that makes sense.

PS - the correct spelling is minuscule, a common error.

The correct spelling is always the correct spelling. Typos are also allowed when letters are adjacent on a keyboard. ;)
