HighView parking fine when ticket purchased

Hi I received a Parking fine today from Highview. My wife was driving the car and she purchased a ticket but no longer has it. I know she purchased the ticket as I followed her in the carpark in my car and left straight away. The machine was one where you entered a reg it wasn't the machine by the entrance but another further away. The letter came with a nice time stamped photo of her car entering and leaving. What should i do. Do i tell my wife to call them and explain she paid on the machine entering her reg. Do I ring them and tell them it can't have been me as the car I was driving was straight in and out, or Shall I ask my wife to just pay the £50

All the above ideas amused us - you are clearly joking.

Or you haven't read a single other Highview thread yet. Please search this forum for that word and read some!

You need to read the NEWBIES thread. We have a forum '2 hour challenge' that will see this PCN cancelled tomorrow.

    NO

what YOU should do is read the NEWBIES FAQ sticky thread near the top of this forum, then use the blue text appeal and appeal as keeper (with no alterations whatsoever)

Even though she has paid and entered her reg into the machine. The must be able to match this information somehow. Maybe she entered it a letter out. The reason I am a bit worried is my sister had a pcp ticket about 6 years ago i passed on advise to her from a forum
to her to ignore all letters. She ended up with a ccj as she moved house and didn't receive the court letter

so add the text from the link by BEAMERGUY to the blue text appeal , adapting it as necessary but DO NOT TELL THEM WHO WAS DRIVING, NOR INFER IT

if in doubt , THE DRIVER entered the VRM into the machine and had a valid receipt

be careful how you word it

you can see its a common issue , and is de minimis

DO NOT IGNORE IT, NOBODY IS TELLING YOU TO IGNORE IT , ONLY A FOOL WOULD IGNORE THIS PCN

Thank you everyone for the clear advise. I think I am up to speed on this now. So I have edited it slightly and will go their website and enter the following appeal as non driver

    Dear Sirs

    Re: PCN No. ....................

I challenge this 'PCN' as keeper of the car.
I am appealing as the keeper and ONLY Schedule 4 of the POFA (or evidence of who was driving) can cause a keeper appellant to be deemed to be the liable party. The PCN makes no attempt to pass liability to the keeper after 28 days. A vehicle can be driven by any person (with the consent of the owner) as long as the driver is insured.!

There is no dispute that the driver was entitled to drive the car and I can confirm that they were, but I am exercising my right not to name that person. As the keeper of the vehicle, it is my right to choose not to name the driver, yet still not be lawfully held liable if an operator is not using or complying with Schedule 4.!You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.!

This exact finding was made in 6061796103 against ParkingEye in September 2016, where POPLA Assessor Carly Law found: ''I note the operator advises that it is not attempting to transfer the liability for the charge using the Protection of Freedoms Act 2012 and so in mind, the operator continues to hold the driver responsible. As such, I must first consider whether I am confident that I know who the driver is, based on the evidence received. After considering the evidence, I am unable to confirm that the appellant is in fact the driver. As such, I must allow the appeal on the basis that the operator has failed to demonstrate that the appellant is the driver and therefore liable for the charge. As I am allowing the appeal on this basis, I do not need to consider the other grounds of appeal raised by the appellant. Accordingly, I must allow this appeal.''

I look forward to your response

you could have just added a section stating that the driver paid for parking and entered the VRM into the machine (like you said above), so to check their records for 15 minutes from the entry time looking for similarities

(bear in mind the driver could have entered your VRM or whatever instead of the vehicle being driven)

and you and the driver need to read this posted earlier this year by MSE

Please also note that the driver paid for parking and entered the VRM into the second machine away from the entrance. Please check your records for 15 minutes from the entry time looking for similarities!

My wife has just told me she had to wait 15 minutes before she could get a ticket as there was a large queue for the machine. I do see if that's why i got a notice (they only check 10 min window)

On that basis I added this. Let me know what you think

Please also note that the driver paid for parking and entered the VRM into the second machine away from the entrance after queuing for at least 10 minutes to pay. Please check your records for 15 minutes plus from the entry time looking for similarities!
