show hands in court
No different to a standard PPC response when appellants ask for an unredacted copy of the PPC’s contract with the landowner. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yes they can. But then the PPC is syaing youre lying. Thats a big step for them to take, in writingSeems to me that an excerpt from a lease is pretty meaningless, anyone who can type could produce one saying whatever they want to.
You can state as wlel that if they are not satisfied a copy of the lease is available directly from the land registry, at their own cost.0 -
Oo-er, I’ve politely responded saying that we’d not be providing a copy and that they should apply to the land registry or view a hard copy if it continues to court.
I suppose the problem with sending an excerpt of the lease is that there’s no mention either way about whether we can or cannot park outside of our house. I’d not be entirely sure what to send, short of the entire document.
Luckily, my husband send a very detailed defence statement which discussed our lease and it’s lack of detail re parking. Interestingly, he is about a month or two ahead in proceedings so I’m curious how they will play it. Go for the double and take u both to court or just one of us for potential damage limitation?
I guess we’ll both have to keep our fingers crossed! Either way, we’re !!!!!!ed if we’re paying until were ordered to!
I’m ever so grateful for your replies, thank you so much.0 -
Apologies for the spelling errors! I’m juggling a small person and my phone!0

If your lease mentions parking, then quote the bits that are relevant and favour you, the leaseholder.
If the lease doesn't mention parking, then you tell the scammers that it is silent on this matter so they cannot see something that is absent, nor can they impose something that is not in your agreement with the landowner.
If your lease mentions Quiet enjoyment, then you quote that.
And of course tell them you will provide the lease to the court as part of your defence should that be necessary.
See what judges have said about residential parking, and quote this to the scammers and MA.
