Good luck for tomorrow OP, having read all this thread I think your defence is well crafted, well argued and a credit to yourself and all the experienced posters who have aided you.0

Doesn't matter, if you are the admitted driver, as I think you are. Concentrate on your other points and what IamEmanresu said.and the PCNs weren't PoFA compliant.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I've only admitted to one, the first one where I had evidence that the RingGo facility didn't work. It was the day my mother first moved into the hotel, that's the only reason I could remember that it probably was me.
The other three could have been one of three of us and were more than likely not me but, I believe I'm right in thinking that the burden of proof is theirs?
I'll keep you all posted.
Thank you, everyone, for your help and especially you CM

Yes, that's good, then you need a printout of the POFA Sch4 in your file, along with having in your bundle, the printed out emails to show you sent your WS and evidence to the other side, in case they pretend they haven't seen your WS/evidence, and you would be left opening and shutting your mouth but with no way to prove they did get it...The other three could have been one of three of us and were more than likely not me but, I believe I'm right in thinking that the burden of proof is theirs?
They do that all the time to try to get adjournments if the case is not going their way.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So I've had a pre chat with the advocate they sent to represent them and guess what, they haven't sent him my bundle!
He's going to try and get it postponed. I've told him in no uncertain terms that I will object to that.0 -

Point out that they are the professionals and you are the litigant in person. There is nothing in the Civil Procedure Rules that allows for professionals to be incompetent and Denton rules should apply.
Other courts allows parties to pass over the court's copy and 10 minutes to read it. No need for an adjournment. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
He's got their copy now. Unfortunately for him, there are around 700pages of it. Mainly bevause I printed off the codes of practice including the Equality Act one!
What are the Denton rules?0 -
Adjourned! They're going to give it a 3hr listing!0

Keep plugging away, you've got them on the ropes I can feel it0

They are using a company that has self-employed advocates. I think he said the company was Hayes or something agricultural like that.
Anyway, as predicted by CM, they tried to say that they hadn't received my bundle. Unfortunately for them, I had copies of the emails I'd sent with the documents attached AND, because I'd also posted the bundle too, a copy of the proof of postage and the Royal Mail's teack and trace showing that it had been signed for by them.0
