Riverside Shopping Erith Centre - Smart Parking

This is a free for 3 hours site and the driver was in the car park for 25 minutes. Smart Parking have sent the PCN because the driver either didn't purchase the appropriate parking time or they remained at the car park for longer than permitted. Is it normal to have to key in your reg number for free parking? Seems to be a confusing scheme for a free parking.

Unfortunately, they were picking up a friend, he/she didn't get out of the car and they don't have any receipts for shopping.

How good is the signage? I'm informed the entrance sign is on a bend and on the blind side to the driver. I'm guessing the driver needs to appeal using the template in the Newbies thread but if the signage is sufficient, are there other grounds to appeal against?

    yes it can be a requirement to enter a VRM on a "free" site

    its not new either , I know of some that have been like that for several years

    just use the BLUE TEXT template "AS IS" , no changes whatsoever

    the aim is to get a cancellation or a popla code

    plenty of grounds for appeal, as listed in examples in post #3 of that NEWBIES FAQ sticky thread

    such as

    NO CONTRACT
    NO LANDOWNER CONTRACT
    POOR AND INDEQUATE SIGNAGE
    POFA2012 failures
    any NTK failures
    any BPA CoP failures
    not the same as BEAVIS

    being just some of them , and yes you use as many as possible, no matter what you think about signage etc

    the PPC has to prove their case on each and every point in order to win, you need just one failure to win, but if you do not mention a particular point , it wont be considered

    so accept nothing , query everything

    Yes it is, however you do have to wonder why you need to enter your VRN when their wonderful infallible ANPR clocks your time on site and effectively knows you were within the free period.
    Only the very cynical amongst us would even think it was part of the scammers money trap!

    Absolutely no legs in that one, makes no difference what so ever.

    Nope it's just a template NTK one letter catches all.

    Smart Parking are a cinch for a keeper appellant (NOT DRIVER!) to beat with the templates in the NEWBIES thread, never mind the signage. You win.

    No it's the keeper that needs to appeal.

    As Redx said, just sent the blue template appeal, as it is.

    I did mean keeper :doh:I got so used to using the word driver so not to give away who was driving.

    I'll sort out the appeal and will do as suggested.

    To add to their misery, complain robustly to your MP, with a bit of luck they may be toast by Christmas.
    You never know how far you can go until you go too far.

    i have just challenged one of these. (yet to get a reply)

    please check the back of your pcn.
    if it says information subject to data protection act then this is wrong! the gdpr came in on 25/05/2018.
    Its understood that GDPR does not require the data subject to give informed consent as a default.
    Consent is one of six legal justifications, and any of them are valid for legitimising the use of personal data.
    "The DVLA are under a legal obligation to provide data to those operating parking schemes, and having a legal obligation is one of the other legal justifications for processing data" (SIC)
    What legal obligation is there for the DVLA to pass on (or sell at a profit) driver details to a private parking scheme operator? Legal implies law which will be covered by an appropriate Act.
    What Act stipulates private parking scheme operators have a legal right to information?
    maybe a clause for redress?
