    I'm not suggesting for a moment the OP should do this but what would stop someone remortgaging the house then putting the proceeds in to a QROPs that is outside the jurisdiction of the courts?

    Because the court would want an explanation as to where the proceeds of the remortgage went? And then have everything else they say disbelieved because theyve been disingenuous/lied.

    Very big. Very clever. If Russian oligarchs get huge awards made against them, despite claiming penury, do you think the court will believe a regular guy who just happened to make his only major asset disappear at, coincidentally, the time he separated from his wife? He would have to show the proceeds were transferred offshore. Doubt he could pull it off.

    So just before you divorce your wife you suddenly decide to remortgage and move the money overseas ....

    Sorry that would scream of trying to hide marital assets

    And I find it difficult to believe that anybody would consider investing in a pension as depravation of marital assets.


    The pension pot would be offered up to the court as part of (the only?) marital asset. It is up to the court to decide how far its reach went in terms of re-allocation of those assets.


    Previous cases have shown the courts have accepted their power does not reach in to certain jurisdictions when it comes to pensions and no sanction was placed on the individual concerned as they had done nothing wrong.


    Legally if not morally i'll grant you..

    Simple. As above remortgage house. Gift half the cash to your sister.

    Put your half of the money in betfair. Bet on an unpopular event at odds of evens that has a very low chance of happening, eg team A to win.

    Put sisters half in betfair (or even better a different exchange to get around fraud and money laundering checks) same event but the opposite outcome, eg team A not to win.. will cost you 5% but cheaper than giving your wife the house.

    If team A loses / draws then you have no cash, your sister now has it all, get her to whack it in bitcoin or something, then Xfer to your wallet. Untraceable. And you've gambled your half away it will look like to the courts.

    If team A wins, just repeat event above giving half cash to sister but then on event setting odds to 3.0.

  • It's worth noting that the UK system isn't 'fault based'. So the fact your wife cheated won't give you any additional rights or advantage necessarily (other than the moral high group that is).
