Property/Will question

Hi

Unfortunately my mother is quite ill and has limited time. Whilst talking the weekend she informed me about her will and I was name as some beneficiary/executor. Also said that the property listed in the will was her previous house and not the one she moved into 2 years ago. She didn't think this fact would be an issue as there clearly is a paper chain/records linking sale and purchase of previous and current property. Does this matter or should she up date her will to reflect the correct property or will it just take a little longer for the will to be actioned as per her wishes?

    If she has left the property to someone specific and she no longer owns that property, the legacy will fail.

    OP, can you check this - do you mean sole beneficiary/executor? Looks like a typo to me.

    That depends on the exact wording of the will, and if you have any siblings or not.

    I can’t see why the will even mentioned the house specifically if you are inheriting everything.

    Would your mother let you see the will or a copy? That way you'll know exactly what the wording is.

    It would also be worth knowing where the original signed will is so that you don't have to search around at home or at local solicitors when the time comes.

    She needs to change the will. Otherwise the house will pass to the residuary beneficiary.

    Which should be the OP if he is the sole beneficiary but he needs to see the the will to confirm that, although a new will to remove all doubt would be the best option.

    Anything else is speculation

    eg. it is usual to have clause to cover a change of house if needed but who knows.
