A few thoughts.
Is the account is it locked to actually your fathers? I see no confirmation either way.
Seocnd, apple are odd and are known to think they continue to own the device and mearly lend its use to you. As such not having a registered account to it would seem strange. Why did you never change the account, especially if you did not have the password.
That said you may get someway if you shame them on social media.
It’s nothing to do with some leasing thing and all to do with securing the device as much as possible. The problem is that these devices store sensitive information and Apple will not just hand over passwords or unlock a device.

Check for Activation Lock before you buy a device from someone else
Before you buy an iPhone, iPad, iPod touch, or Apple Watch from someone other than Apple or an authorized Apple reseller, make sure that the device is erased and no longer linked to the previous owner’s account. Ask the seller whether or not they've turned off Activation Lock, then follow these steps:
1. Turn on the device!and slide to unlock.
2. If the passcode lock screen or the Home screen appears, the device hasn't been erased. Ask the seller to completely erase the device by going to Settings > General > Reset > Erase All Content and Settings. Don't take ownership of any used iPhone, iPad, or iPod touch until it's been erased.
3. Begin the device setup process.
4. If you're asked for the previous owner’s Apple ID and password, the device is still linked to their account. Hand the device back to the seller and ask them to enter their password. If the previous owner isn't present, they can remove the device from their account by signing in to icloud.com/find. Don't take ownership of any used iPhone, iPad, or iPod touch until it has been removed from the previous owner’s account.
You will know that a device is ready for you to use when you're asked to "Set up your iPhone," “Set up your iPad," or “Set up your iPod” the first time you turn it on.
If you buy a device that's still linked to a previous owner's account, contact them!as soon as possible and ask them to erase the device and remove it from their account.
Anyone can make up any story to get access to your personal information and I’d rather have Apple make it near impossible to access any of my devices without my authorisation.
I have handed 4 Apple devices down to family members wiping them first and making sure I don’t have them linked to my account.
Unfortunately if someone dies then in this digital age you may have to look at leaving passwords and usernames in a will and even then it might not be legally correct to get access to the digital content.This is a system account and does not represent a real person. I've heard that Google releases account passwords to next of kin on submission of a death certificate. True or false?
And: Rendering a computer hardware device useless when someone dies probably breaks UK consumer law. OP isn't asking for access to the data, merely for the Apple device to be made usable again. Apple could offer a service to reset devices on production of reasonable evidence. I'm surprised this hasn't been tested in a court case yet.0 -

Who knows but I do agree that if I leave CLEAR instructions in a will that others can access my devices and digital content then there should be a path to do so. However if I don’t leave instructions in my will then I don’t want someone producing my death certificate so they can just get to devices and content to be greedy or nosey :rotfl:This is a system account and does not represent a real person. As it appears to be extremely difficult to unlock/reset an iPad that someone actually owns, how do thieves ever sell on stolen iPhones or iPads?
Is there a market stall service that completely wipes these devices? If so then I wonder if that's the easiest option for the OP?0 -
Yes it is possible to use an octopus device to completely wipe devices and flash a new IMEI.
However this is illegal in most countries0 -
They hope to steal one where the security hasn't been setup properly or they try to offload it to someone who won't check that it has been secured and they can't use it before they run off with the money. If you know his old password have you tried gaining access to that? then you can just reset the password and create a new one

Is the email address still active?
If so and you have access then is it possible to 'reset password' on the icloud.com log on?
I have tried to reset password by the email but again this isn't possible as you have to answer security questions, it isn't right either really as it feels like I am hacking into my dad's email.
Beside I can't guess the answers to the security questions anyway even if the email is still activeThe mind is like a parachute. It doesn’t work unless it’s open.:o
