Hi all.

Parking contravention: Failure to pay for the duration of stay.
Where: Planet Ice, Peterborough.
Parking Company: Premier Park Ltd.

I'm at the POPLA appeal stage, about to submit my text, and would be massively grateful for advice on whether i've missed anything or got it wrong, etc.
There has been no admittance of who was driving. As keeper, I used the blue text in the Newbies thread for the initial appeal.
I hope that the POPLA appeal i've drafted contains all the relevant defences? I'm especially interested in people's opinions on the photos of the signage we've had taken (in the same conditions) - but as a new user i appear to be unable to add links to my dropbox images? Any ideas how i can share them?

I do appreciate that this is a self-help forum to a great degree, so I've tried to get as far as i could on researching content and similar cases.

As the NtK explains, this car park is now ANPR controlled by Premier Park Ltd. It never used to be, and i can only assume the driver didn't spot the tiny sign on the way in. It was night, so completely dark as shown in the ANPR pictures, and almost all of the signs are unlit which is what the appeal is partly based on.

I'm going for:
1. The Notice to Keeper (NTK) was not compliant with the Protection of Freedoms Act 2012 (POFA) and as such no keeper liability can be established.
2. The operator has not shown that the individual who it is pursuing is in fact the driver who may have been potentially liable for the charge
3. Inadequate and unclear signage
4. Premier Park has a lack of standing or authority from the landowner to issue tickets and pursue charges in their own name at court.

I'll bung the full appeal text in the next post.

seems ok on a skim read

embed the photos etc and save as a pdf

check if the NTK arrived in the correct timeframe of 14 days for anpr or day 29 to day 56 for windscreen tickets

check for any other POFA errors

check for any BPA CoP errors

perhaps add a "not the same as beavis" paragraph too

Yes the NTK arrived in the correct timescale. There was no windscreen ticket.
I thought i'd added reference to Beavis in point 3? Do you mean somewhere more prominent?

I really wanted to add links to the dropbox images of the NTK and signage in this post, for reference and comment, but the forum says i'm too new as a user. Any ideas as to how i might add them?

Suggestion you copy the correct dropbox link into a post and edit as follows->
say link is ->
http://goodurl.com

change it to
hxxp://goodurl.com

and a forum helper will then convert the link correctly and post it in a reply for you

Strange so you changing the 'tt' to 'xx' and broke the url link and it didn't work.
Hmm the forum usually suggests this approach.

Sorry, should have been clearer. I used hxxp in place of the usual, to no avail. I suspect the forum post mechanism attempts to recognise the pattern of a URL.

If anyone has any specific comments about these images, and in particular if any of them are detrimental to the case, i'd welcome the feedback.
