I am drafting an appeal to popla,
Just wanted to ask if i dont reveil the drivers details am i as the registered keeper still goin to be liable.
As i am drafting the appeal stating i am the registered keeper but wasn't the driver parking in the shopping retail park.
I have read some threads here but still confused.
Any help would be appreciated.

Hi All,
Just followed the steps but had my POPLA appeal rejected. Please see response below. I don't believe I ever identified myself as the driver. Is there anything more I can do to avoid paying this as I paid the charge but the app defaulted to a dfferent (old) car reg. Thanks JMK
The appellant has identified himself as the driver of the vehicle on the day of the parking event, and therefore, I am considering the appellant’s liability for the PCN. When parking in a private car park, the motorist forms a contract with the operator by remaining on the land for a reasonable period. The signage at the site sets out the terms and conditions of this contract. In this specific car park, the terms and conditions state: “Vehicles parked without authorisation or in breach of any of the following conditions may receive a PCN: failure to purchase and display a valid parking ticket, APCOA Connect session or valid parking permit”. The operator has issued the PCN as the appellant did not purchase a valid ticket. Images from the operator’s Automatic Number Plate Recognition system have been provided, which show that the appellant’s vehicle entered the car park at 06:52 and exited at 18:45 on the day in question, staying for a total of 11 hours and 53 minutes. While I appreciate that the appellant made a payment and has provided his receipt to prove this, by his own admission he did not provide the correct vehicle registration when doing so. Due to this, the operator would not have been able to trace the appellant’s payment to his vehicle. Therefore, the appellant’s parking payment would not have been valid to entitle his vehicle to park at the site. I note that the app may have defaulted to a previous vehicle registration, however it is solely a motorist’s responsibility to ensure that they have paid for the correct vehicle registration number. Furthermore, I can see that within the comments section of his appeal, the appellant has raised additional grounds of appeal. The motorist comments stage of our appeal process is to allow the motorist to expand upon their initial grounds of appeal in light of the evidence provided by the operator. POPLA does not allow the appellant to raise new grounds of appeal at this stage, and any new grounds of appeal raised will not be considered. Therefore, I will not be addressing this as part of my response. Ultimately, it is a motorist’s responsibility to ensure they adhere to the terms and conditions of a site when parking on it. As the appellant did not make a valid payment, he has failed to comply. As such, I conclude that the PCN was issued correctly. Accordingly, the appeal is refused.0 -

YOU are th eonly one who KNOWS what was said. So go through your appeal and POPLA appeal and see if the driver was ID'd. If not, then complaint to POPLA - however this will be in a new thread.0
