Ebay sided with seller

I bought two 2nd hand strimmer batteries on ebay. It said not tested in listing due to not having battery charger. fair enough they came today

I bought the batteries neither work in proper charger one of batteries was slightly damaged.

I noticed later seller had the charger seperate in a listing so could have checked.

I asked for a refund and buyer referred this to ebay, and they gone in there favour

"We're sorry that you had a problem with your purchase. However, the seller described the item accurately and buyers can get a refund only if there's something wrong with the item."

I rang ebay but they referred me to paypal I cant seem to get in touch with paypal I rang them but keep going round in circles.

How can ebay side with seller the batteries are defective and or something wrong with the item totally going against ebays own rules

I have 444 feedback and customer for 17 years not once complaint I ant a scammer

    If you buy something second hand as "not tested" then you should expect it not to work, I don't see where the seller has misdescribed.
    If you're within 14 days and it's a business seller you have the right to a "change of mind" return, you would have to pay for return postage.

    Yes he appears to be a trader and yes I only got it on 23rd came today

    So they can have a get out clause because it wasnt tested

    He is selling the charger so he could have tested it I suspect they knew it was faulty they have even now changed orginal advert it didnt say for spares like it does now. It only stated Black + Decker 36V, 2.0 Ah Lithium BL2036 (untested As No Charger)

    Return it under distance selling, although you will have to pay return postage.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    If he's a trader (i.e. registered as a business seller on ebay), he can't refuse returns.

    One was 'slightly damaged' I take it that means it was not described as such in the listing?

    Open a case on Paypal and state that (don't waffle and don't confuse the rep).

    If you can't open a case you may have paid by guest, which means you need to ring. Just explain that one item is damaged.

    When I found out the batteries were faulty I sent a polite message and a picture showing charger showing fault. I was expected to send them back to the seller for a refund at my cost. However, he immediately escalated it to eBay.

    I find it increasing frustrating and impossible to appeal against ebay decision despite it saying I could appeal nor does the seller who clears houses for a living, provide information on returns address

    ebay also refusing to give me sellers address I am on phone to them as we speak and told me so

    As above if they are a business then their details are displayed on their account, you don't need eBay to give you the address.
