Parking Eye Ticket and Equita Letter

My son has received a ticket from a car park, The car park is notorious for not registering parking properly. He thinks he paid for his parking that day but can't prove it. He ignored the ticket so I assume, he now can't appeal? He has now had an Equita letter for £220. He wants to ignore this too and wait until they take him to court in the the hope that he can settle the court issue for less than £220
Does anyone know if he could now appeal at all? he has made no contact with anyone at all since the first letter, which came around the beginning of Aug 2017.

    he had 28 days from the first NTK to appeal, so that ship has long since sailed

    a pity really because the chances are that an initial appeal to PE and to popla may well have seen it off by now

    they may have failed certain rules or laws , hence the equita letter

    PE have 6 years to try a court case and the chances are that he will pay less even if he loses, or can claim up to £95 if he wins

    at this moment in time there doesnt seem any suitable course of action, so come back if he receives an LBC or an MCOL in the post (DO NOT IGNORE THESE)

    PE usually send Equita letters when there is an issue with the paperwork or where there was an issue with the car park on the day e.g. faulty machine.

    You can check if it is the paperwork by searching for "golden ticket"

    Having Equita involved is, paradoxically, reasonably ‘good’ news. While PE are the most litigious parking company in the UK, they are usually fast out of the traps to issue court proceedings.

    I can’t instantly recall a PE case where they’ve exhausted debt collector intervention, then proceeded to court, and I’ve definitely not seen that happen with Equita (who come from the same CAPITA stable as PE) involved.

  • Thanks everyone. So should he continue to ignore the Equity letter, just worried that they employ bailiffs? I've heard that this won't give him a bad credit rating? i really don't want the rest of the household to be affected by a bad credit rating. If that is the case I'll make him pay up!

    Whether they employ ‘bailiffs’ or not is immaterial. For bailiffs to be deployed you would first need to be taken to court, you lose the case, you are told to pay costs by the judge, you decide not to pay them (by omission or commission). Unless the costs amount to over £600 (and typically a private parking small claim award is £175ish) PE won’t be able to apply for a High Court writ - and the boys from ‘Can’t Pay, We’ll Take it Away’ wont be visiting you any time soon!

    A ‘bad credit rating’ can only be possible in this context if the same route above is followed and again the costs aren’t paid. The bad credit rating will apply to the individual!

    It lasts 6 years.

    I know companies such as Equita do employ private local contractors to visit houses to try and collect money.

    And Lowell Portfolio and Equity etc do show as having done credit checks on experian so I want to give my son the best advice I can now he is in the situation he is in.

    umm , you or your son do not have a signed credit agreement with those companies ,,,,,,,,,,,,,, or are there other skeletons in your cupboard?

  • no none at all. thats why i don't want to start obtaining any adverse info on any credit checking sites etc.

    any searches regarding name/address will be SOFT searches and NOT show to any other potential company that you wish your son to obtain credit from
