Driving without insurance

Hi guys I got caught driving without insurance as I sold my car yesterday and he said to keep it running untill tomorrow so I started my insurance next day at 9:00 but I started driving at 8 40 as I didn't think anything for the 20 minutes but as I got to the end of the street a cyclist went over the give way line as I was on the main road came straight in front my car? I don't know why maybe they wanted a insurance claim so now the police got called I explained the situation and they said at the time of incident you had no insurance as it started at 9 and it happened at 8 40.
Now what they said you have been cautioned you have the right to remain silence .... They said I would be getting 6 points driving without insurance and 3 points. So what does you have been cautioned mean?

    (You only cannot drive if you have been banned or a condition that means you mustn't - have you?)

    Yes.
    Until it goes to court, you have not been found guilty of any offence so can keep driving.
    However, as the incident occurred before your new insurance policy had started, the insurance company concerned may well decide to refuse to provide cover for you and they may cancel your policy.
    If this happens, getting a new policy may well be very hard or expensive.
  • It was not a new policy it was a current policy as I had sold they car yesteday and switched it to the this car at 9 I called my insurance and they said I don't have to tell them anything as I have been cautioned and not convicted of driving without insurance.

    But if you do get points on your licence, you need to tell them, unfortunately as if you have another accident, you may not be fully insured if you don't.

    i know you said you swapped it over but alot of insurances allow you to drive another car third party

    so surely you would be insured third party to drive another car on the insurance you already had

    so surely you were not driving without insurance
  • Third party cover only applies to cars you do not own. That means that once you have bought the new car, it's not covered on "third party"

    If your insurance company say you are covered then you have nothing to worry about (they decide whether you are covered by them or not, not the police). If you were told it would be fine by the insurance company on the phone, demand a letter explaining that you were indeed under cover by your insurance company as you had informed them of the vehicle change. For administrative reasons this only went on record the next day. If any incident or claim were to have occurred they would have had to pay out.

    In court, present this letter and you will be fine.

    Do this before any phone recordings are deleted.
