Accident - No one in driving seat - still being blamed due to no independent witness!

    Depends, a friend of mine was a passenger in a taxi that was t-boned at traffic lights, he was accepted as an independent witness by both sides when it ended up in court.

    Obviously no help to OP, he did not have a dash cam:p. If he had, parking mode may have recorded the other vehicle and / or proven his vehicle was not moving at the time of impact. This is a discussion and I hope my comments may be of interest others?

    Most dash cams have a wide angle lens. I am pleased to report the police were able to trace the lady who damaged my car from the footage recorded. This was the damage she caused to the side of my car > Damage%20to%20UP02%20BOB_zpsrxv1ywfr.jpg

    Well, maybe these passengers can become independant witnesses OUTSIDE the car, just in the same way as you can (by their account) be in the car.

    Report it to your insurers. In your account, you tell the truth and provide photographic evidence. His insurers will see him as a liar.

    Your passengers then start an injury claim against him.

    So long as the insurer doesn't already have their name maybe they are just strangers who was at the shop too

    Yep roll over and loose ncb and excess letting the other guy get away with fraud.

    Because let's face it, insurers are unlikely to investigate the legitimacy in such a small claim and with only evidence being hearsay.
