So if that's the case why don't people advise just to put john smith in North Dakota as the driver and forget all about it?

I already explained why in a previous reply

    ie:- PERJURY (criminal record)

Obviously one has to be truthful when dealing with courts etc.
But need one be truthful to a parking company? I'm not speaking ethically. Ethically one must always be honest.

if you are going to use an ENGLISH LAW named POFA2012 to name the driver and provide an address, then if you are not truthful when quoting said law then its lying , in writing , to an invoice that could be produced in court later

if the PPC then decide to issue an MCOL to you as keeper and a judge asks you in person if the paperwork in front of him (your naming of the driver) is truthful or not , and you say yes and it is proved to be a lie , the consequences are far worse for you

as I said , the HUHNES did it and served time for it , albeit that was about a speeding ticket and points on a licence and a fine for VICKY

you are advised not to go down that road

if it could be done , the sticky thread would say , name the driver , as :-

    Mr S Claus
    Elf Village
    The North Pole

you need to purge your head of such silly notions , its a dangerous route to follow

We do not recommend nor condone any action which is untruthful. We would not want to help anyone to sink to the level of the skimmers we are fighting.

Redx has explained this; there are only so many ways we can say it. We’ve run out of those. If you want to plough that furrow, just do it, but don’t blame us if it blows up in your face.

Remember, ParkingEye are the most litigious PPC in the land and will go to extraordinary lengths (and expense) to block any loophole people might be looking to exploit - ask Barry Beavis.

Having someone ‘doing a stretch’ would do wonders for them to ‘encourage les autres’.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Fair enough, point taken. and thank you.

It's just SO VERY frustrating to be a person who genuinely wants to pay for fair parking and not have to sift through all this data plotting a scheme to nullify this pcn. A while a ago I parked in Sainsbury. You drive up to the entry barrier, press a button, take a ticket with a bar code, drive in and park. Do your shopping. load up your car, drive up to the exit barrier, insert the ticket, out pops the parking fee. Pay the fee & drive off.

It's just so refreshing to have a system where you pay for what you use and no headaches. Life should be this simple. We shouldn't all have to be going on here trying to familiarize ourselves with legal rulings when we were not trying to avoid parking. Its just frustrating.

so dont tell us , tell your mp

complain in writing to your local MP and ask them to support the private members bill by Sir Greg Knight due for its second reading in late feb/early march 2018

it might not address all your issues, but that bill is a step in the right direction

I feel that the current set up allows these companies to legally "mug people."

Honest people going innocently about their business, and they just get mugged. The law allows it. I can't understand how the Beavis thing went through. Did the judge not realize what they doing to society? These parking companies are making millions bcos people pay out of fear.

Do you have a link for the Greg Knight thing? I've never heard of it.

I'm just not sure if it would be believable that it only arrived on Nov 1st if it is dated Oct 21st.

POPLA will not believe you, so forget that 'no keeper liability' argument and concentrate on the other usual templates.

We believe you. We know PE send their PCNs out on a completely different date than the PCN suggests, seen it myself.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

there were 11 judges in 3 courts in the BEAVIS saga

read up on it if you really want to know, but we have been dealing with the aftermath of it for the last 2 years already

as for the private members bill , BARGEPOLE posted about it in a post and thread a couple of months ago , but bear in mind the proposals have not been written yet , expect them a few weeks before the debate

you just need to accept your rookie status and do plenty of reading and searching this forum if you want to get up to speed on this topic

remember , people like me were like you 5 years ago, but have learned the topic over time and grown with it

you certainly wont get your head around this over a short period of time

as for your comments , we agree with you , which is why as free volunteers we try to help and give free advice on here

the power to change it lies with your local MP

so even if you dont find the details, your MP can and should do so

you will not get better advice from this forum, if you where to go out and pay for it ....

unless there is a good reason to not honestly name the driver abroad ..... hiding in Spain ? ;)

then that is the best advice ....

    link re your MP ..........................

this is a copy of a post by Bargepole ....

    "Some action at last:

    http://services.parliament.uk/bills/2017-19/parkingcodeofpractice.html

This Private Member's Bill has Government and cross-party support, and stands a good chance of making it into statute.

The full text of the clauses will be published nearer the date of the second reading, but my sources tell me it's something we should support.

Now would be a good time to write to your MP urging them to support it."
