Faulty VaVa Voom bluetooth speaker and offer

Hi
My son bought me a VaVa Voom 21 bluetooth speaker for Christmas last year via Amazon for £69.99
Recently after only 10 or less uses as a wired device the audio socket broke off inside the unit (also the battery is not holding charge as is showing up in many reviews now)
I contacted VaVa Voom suppliers direct and they are offering me a half refund.
I have replied saying that I am entitled to a repair, replacement or refund as this 10 month old unit is not fit for purpose. Just checking I am right please?
Also they want me to pay return costs for the faulty item which I would refuse to do
TIA

Your sons legal rights are with the vendor .
You are not the purchaser .0 -
Always confuses me why someone goes off on one at a company claiming they know their "rights" when they clearly don't and haven't checked before hand.
As above, firstly these are not your consumer rights to exercise, they are your son's.
As it is over six months since purchase you (or more accurately, your son) will need to provide an independent report stating the speaker was inherently faulty (i.e. from the point of manufacture). Once this is provided the retailer can choose whether to replace, repair or refund, you (your son) can specify a preference but can't demand anything. If the retailer chooses to refund they can deduct an amount for the usage you've had.
Try calming down, getting the required report then get your son to speak to the retailer to see what can be done.0 -
Thanks for the quick replies.
Yes I do realise that the contract is between my son and the retailer. Unfortunately there are reasons why I have to act on his behalf on such occasions and incorrectly gave the impression that I had rights which are his.
Interestingly, I was not aware of the change from the Sale of Goods Act to the Consumer Rights Act since my retirement and am pleased to be updated.
Professionally I purchased many hundreds of thousands of pounds of IT equipment and was fully aware of the requirements of the old Act and had no problems with dealing with faulty goods proved not fit for purpose.
I am actually a (retired) Chartered Engineer specialising in electronics and IT and know that 10 uses of an audio port must mean the unit was inherently faulty when purchased but I take it I can't write my own report!?;)
I am pleased to learn about the six month rules and conditions now applying.
I have looked at my email to them and also referring to the guarantee said I would leave the choice of reparation "up to you". I did not demand anything.
I did however come here to check if I was completely right in my expectations of the company and in the light of the newer Consumer Rights Act, I wasn't.
Thanks again

Postscript: As I was polite to the company and did not 'go off on one' (I get disappointed not angry in situations like this), VaVa are refunding the whole amount.
They are also not making that model any longer.

Really works best if you get them onside .
CS work best if you don't get their backs up .0
