Fault on Roundabout.

Hello,

Recently I had a car accident on a roundabout, which is now coming back that the third party insurer is putting myself at fault. I’m finding this hard to accept at the moment. Here is what happened.

I approached the roundabout in the second lane as I was taking second exit. On the opposite side to the roundabout only 1 single lane of traffic goes around it, the other lane merges off to the left (First exit) as a flow of traffic. I saw that I was fine to go onto the roundabout and as I did, a car come flying around the Roundabout in the Lane that should of merged off to the left, undercutting their flow of traffic with no sign of indication then crashing into the side of my car.

I have sent photos of the road marking to my insurance clearing the lanes are visible. The drivers intention was to clearly beat traffic, undercutting around the roundabout causing them to cave into myself.

The driver then got out of their vehicle apologising to myself and admitting they should not have did what they did on the roundabout. I have told my insurance exactly this.

My insurance have an aerial image of the roundabout showing lanes. I’ve also sent them close up photos of the lane marking which I took myself to show them.

I’m aware that we give way to right, but honestly where do I stand in terms of liability when this vehicle was not only in the wrong lane, undertook traffic around a roundabout also not indicating and letting other know their intentions.

There is no CCTV in the area and I do not have a Dashcam. Police were not called to the scene of the accident so no report could be made.

I’m honestly shocked how this event has turned out and am trying to prove my innocence.

    As far as I would be concerned traffic on the roundabout has priority so you are at fault for pulling out. His speed and anything else he may or may not have been doing is largely irrelevant and unprovable.

    I understand what you are saying, I really do. The only issue I have with this incident is that the car that come around the roundabout was in a Lane that has a directed flow coming off to the left (first exit). My argument to this simply is that, since that exit on the left is a constant flow of traffic, at which points is it then deemed safe to come onto the roundabout since that lane is always in use and therefore the roundabout always has a car on it.

    Obviously I would not have left if I did not feel generally safe in doing so. The decision the other car decided to make put other lives in danger. I of course have thought about my own actions too and really cannot see how coming onto the roundabout in an appropriate manner when it was safe to do so puts myself at fault.

    Really upset and frustrated with it all. :-(

    just to clarify, the person came from your right in their left lane? Is this lane marked for left turn only? IF not then they have every right to go straight through the roundabout in that lane and you were to give way

    So you pullled out on a car coming from your right?

    Without seeing the roundabout, the first lane of a roundabout is mostly used for turning left, the first exit and for going straight ahead, the second exit. This is of course if there is no turn left arrow on the first lane. So the driver did nothing wrong by taking the first lane and not turning left.
    You are to blame, you must always remember never to expect indicators or even trust them when they are flashing.

They however crossed lanes last minute undertaking traffic with the intentions of taking the second exit. Their lane is marked for first exit only. But these lane marking were ignored and they cut right accords them very last minute.
  • In the absence of an independent witness, dashcam footage or a formal admission from the other party, the best you could hope to achieve is 50:50 and it's likely you will continue to be deemed to have been totally at fault. From your description that would be unfair because the other driver has been a clown, but that's how it will play out. I can't see how you can prove your innocence.

    So he was in the wrong lane, you thought he was going left and pulled out in front of him?
